SYNOPSIS AS INTRODUCED:
 
20 ILCS 2105/2105-355 new

    Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides that notwithstanding any law of the State or political subdivision of the State to the contrary, an individual or entity may engage in the practice of one of the specified professions without being licensed under any Act administered by the Department, provided that the individual or entity (1) is duly licensed by, or otherwise authorized to practice the profession by, any state or territory of the United States, (2) restricts his, her, or its licensed or authorized services and duties solely to the provision of care or service at a free medical clinic as defined in certain provisions of the Good Samaritan Act, and (3) provides only the care or services that the individual or entity is licensed or otherwise authorized to provide by any state or territory of the United States. Defines "specified professions". Makes other changes. Effective immediately.

1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Department of Professional Regulation Law of
5 the Civil Administrative Code of Illinois is amended by adding
6 Section 2105-355 as follows:
 
7     (20 ILCS 2105/2105-355 new)
8     Sec. 2105-355. Licensing exemptions for Good Samaritan
9 Free Clinics
10     (a) Notwithstanding any law of the State or political
11 subdivision of the State to the contrary, an individual or
12 entity may engage in the practice of one of the specified
13 professions without being licensed under any Act administered
14 by the Department, provided that the individual or entity:
15         (1) is duly licensed by, or otherwise authorized to
16     practice the profession by, any state or territory of the
17     United States;
18         (2) restricts his, her, or its licensed or authorized
19     services and duties solely to the provision of care or
20     services at a free medical clinic as authorized in
21     subsection (b) of Section 30 of the Good Samaritan Act; and
22         (3) provides only the care or services that the
23     individual or entity is licensed or otherwise authorized to

1     provide by any state or territory of the United States.
2     (b) For purposes of this Section, "specified professions"
3 means the following professions: physician, chiropractic
4 physician, dentist, optometrist, physician assistant,
5 pharmacist, podiatrist, athletic trainer, nutritionist,
6 massage therapist, advanced practice nurse, licensed practical
7 nurse, registered professional nurse, physical therapist,
8 social worker, or any other profession licensed to practice the
9 treatment of human ailments.
10     (c) The requirements of this Section 2105-355 do not apply
11 to the exemptions authorized by the Department pursuant to
12 Section 2105-400 of this Act.
 
13     Section 99. Effective date. This Act takes effect upon
14 becoming law.
