AMENDMENT TO HOUSE BILL 4252

2     AMENDMENT NO. ______. Amend House Bill 4252 by replacing
3 everything after the enacting clause with the following:
 
4 "Section 5. The Illinois Underground Utility Facilities Damage
5 Prevention Act is amended by changing Section 2.2 as follows:
 
6     (220 ILCS 50/2.2)  (from Ch. 111 2/3, par. 1602.2)
7     Sec. 2.2. Underground utility facilities. "Underground
8 utility facilities" or "facilities" means and includes wires,
9 the internal electric grid of a wind generation farm facility,
10 ducts, fiber optic cable, conduits, pipes, sewers, and cables
11 and their connected appurtenances installed beneath the
12 surface of the ground by:
13         (1) a public utility as defined in the Public Utilities
14     Act;
15         (2) a municipally owned or mutually owned utility
16     providing a similar utility service;

1         (3) a pipeline entity transporting gases, crude oil,
2     petroleum products, or other hydrocarbon materials within
3     the State;
4         (4) a telecommunications carrier as defined in the
5     Universal Telephone Service Protection Law of 1985, or by a
6     company described in Section 1 of the Telephone Company
7     Act;
8         (5) a community antenna television system, as defined
9     in the Illinois Municipal Code; and
10         (6) any other entity owning or operating underground
11     facilities that transport generated electrical power to
12     other utility owners or operators.
13 "Underground utility facilities" or "facilities" means and
14 includes wires, ducts, fiber optic cable, conduits, pipes,
15 sewers, and cables and their connected appurtenances installed
16 beneath the surface of the ground by a public utility (as is
17 defined in the Illinois Public Utilities Act, as amended), or
18 by a municipally owned or mutually owned utility providing a
19 similar utility service, except an electric cooperative as
20 defined in the Illinois Public Utilities Act, as amended, or by
21 a pipeline entity transporting gases, crude oil, petroleum
22 products, or other hydrocarbon materials within the State, or
23 by a telecommunications carrier as defined in the Universal
24 Telephone Service Protection Law of 1985, or by a company
25 described in Section 1 of "An Act relating to the powers,
26 duties and property of telephone companies", approved May 16,

1 1903, as amended, or by a community antenna television system,
2 hereinafter referred to as "CATS", as defined in the Illinois
3 Municipal Code, as amended.
