AMENDMENT TO HOUSE BILL 1855

2     AMENDMENT NO. ______. Amend House Bill 1855 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Environmental Protection Act is amended by
5 changing Section 3.235 as follows:
 
6     (415 ILCS 5/3.235)  (was 415 ILCS 5/3.17)
7     Sec. 3.235. Industrial process waste. "Industrial process
8 waste" means any liquid, solid, semi-solid, or gaseous waste
9 generated as a direct or indirect result of the manufacture of
10 a product or the performance of a service. Any such waste which
11 would pose a present or potential threat to human health or to
12 the environment or with inherent properties which make the
13 disposal of such waste in a landfill difficult to manage by
14 normal means is an industrial process waste. "Industrial
15 Process Waste" includes but is not limited to spent pickling
16 liquors, cutting oils, chemical catalysts, distillation

1 bottoms, etching acids, equipment cleanings, paint sludges,
2 incinerator ashes (including but not limited to ash resulting
3 from the incineration of potentially infectious medical
4 waste), core sands, metallic dust sweepings, asbestos dust, and
5 off-specification, contaminated or recalled wholesale or
6 retail products. Specifically excluded are uncontaminated
7 packaging materials, uncontaminated machinery components,
8 general household waste, landscape waste, perlite rock, and
9 construction or demolition debris.
