AMENDMENT TO HOUSE BILL 1721

2    AMENDMENT NO. ______. Amend House Bill 1721 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Hospital Licensing Act is amended by adding
5Section 4.7 as follows:
 
6    (210 ILCS 85/4.7 new)
7    Sec. 4.7. Additional licensing requirements.
8    (a) A hospital located in a county with fewer than 325,000
9inhabitants may apply to the Department for approval to conduct
10its operations from more than one location within the county
11under a single license at a separate building or facility
12already licensed as a hospital. The operations shall be limited
13to psychiatric services. The host hospital shall house the
14licensee. The licensee's application shall be supported by
15information that its operations at the host hospital will
16provide access to necessary services for the region that the

1host hospital does not provide. The services proposed by the
2licensee at the host hospital shall not consist of emergency
3services.
4    (b) The portion of the facilities or buildings operated by
5the licensee at the host hospital shall be leased in part and
6operated by a single corporation or other legal entity serving
7as the licensee and shall have a single:
8        (1) board of directors with the responsibility for
9    governance, including financial oversight and authority to
10    designate or remove the chief executive officer;
11        (2) medical staff accountable to the board of directors
12    of the licensee and governed by a single set of medical
13    staff bylaws and associated rules and regulation of the
14    licensee, with responsibility for the quality of the
15    medical services provided by the licensee at the host
16    hospital side; and
17        (3) chief executive officer, accountable to the board
18    of directors of the licensee, with management
19    responsibility for the licensee's operations at the host
20    hospital site.
21    The host hospital and licensee shall be jointly responsible
22for hospital licensing requirements relating to design and
23construction, engineering and maintenance of the physical
24plan, waste disposal, and fire safety.
25    (c) The licensee and host hospital shall notify the public
26and patients through general signage and written notification

1provided upon admission that services are provided at the host
2hospital site by 2 separately licensed hospitals. The signage
3shall specify which services are provided by the host hospital
4or the licensee or both.
5    (d) One emergency department shall serve the host hospital.
6Patients shall be notified that emergency services are provided
7by the host hospital. Those patients that require admission
8from the emergency department to a service that is operated by
9the licensee shall be admitted according to the Emergency
10Medical Treatment and Active Labor Act regulations and
11transferred to the licensee. The admission, registration, and
12consent form documents shall be specific to the licensee.
13    (e) The licensee and host hospital shall submit to the
14Department a comprehensive plan describing the services and
15operations of each facility or building and between the
16licensee and host hospital, and how common services or
17operations will be coordinated between the various locations.
18Nothing in this Section relieves a hospital from the
19requirements in the Illinois Health Facilities Planning Act.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
