SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/27-3   from Ch. 122, par. 27-3
105 ILCS 20/1   from Ch. 122, par. 771

    Amends the School Code and the Silent Reflection and Student Prayer Act. Requires that the Pledge of Allegiance be recited prior to the observance of the required brief period of silence at the opening of each school day by pupils in elementary and secondary educational institutions supported or maintained in whole or in part by public funds (now, no time of day or order of recitation is specified). Effective immediately.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by changing Section
5 27-3 as follows:
 
6     (105 ILCS 5/27-3)  (from Ch. 122, par. 27-3)
7     Sec. 27-3. Patriotism and principles of representative
8 government - Proper use of flag - Method of voting - Pledge of
9 Allegiance. American patriotism and the principles of
10 representative government, as enunciated in the American
11 Declaration of Independence, the Constitution of the United
12 States of America and the Constitution of the State of
13 Illinois, and the proper use and display of the American flag,
14 shall be taught in all public schools and other educational
15 institutions supported or maintained in whole or in part by
16 public funds. No student shall receive a certificate of
17 graduation without passing a satisfactory examination upon
18 such subjects.
19     Instruction shall be given in all such schools and
20 institutions in the method of voting at elections by means of
21 the Australian Ballot system and the method of the counting of
22 votes for candidates.
23     The Pledge of Allegiance shall be recited prior to the

1 observance of a brief period of silence required under the
2 Silent Reflection and Student Prayer Act at the opening of each
3 school day by pupils in elementary and secondary educational
4 institutions supported or maintained in whole or in part by
5 public funds.

7     Section 10. The Silent Reflection and Student Prayer Act is
8 amended by changing Section 1 as follows:
 
9     (105 ILCS 20/1)  (from Ch. 122, par. 771)
10     Sec. 1. In each public school classroom the teacher in
11 charge shall observe a brief period of silence with the
12 participation of all the pupils therein assembled at the
13 opening of every school day. In classrooms where pupils are
14 required to recite the Pledge of Allegiance under Section 27-3
15 of the School Code, the period of silence shall take place
16 after such recitation. This period shall not be conducted as a
17 religious exercise but shall be an opportunity for silent
18 prayer or for silent reflection on the anticipated activities
19 of the day.
