AMENDMENT TO SENATE BILL 775

2     AMENDMENT NO. ______. Amend Senate Bill 775 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Lottery Law is amended by changing
5 Section 21.5 as follows:
 
6     (20 ILCS 1605/21.5)
7     Sec. 21.5. Ticket For The Cure.
8     (a) The Department shall offer a special instant
9 scratch-off game with the title of "Ticket For The Cure". The
10 game shall commence on January 1, 2006 or as soon thereafter,
11 in the discretion of the Director, as is reasonably practical,
12 and shall be discontinued on December 31, 2011. The operation
13 of the game shall be governed by this Act and any rules adopted
14 by the Department. The Department must consult with the Ticket
15 For The Cure Board, which is established under Section 10-13 of
16 the Department of Human Services Act 2310-347 of the Department

1 of Public Health Powers and Duties Law of the Civil
2 Administrative Code of Illinois, regarding the design and
3 promotion of the game. If any provision of this Section is
4 inconsistent with any other provision of this Act, then this
5 Section governs.
6     (b) The Ticket For The Cure Fund is created as a special
7 fund in the State treasury. The net revenue from the Ticket For
8 The Cure special instant scratch-off game shall be deposited
9 into the Fund for appropriation by the General Assembly solely
10 to the Department of Human Services Public Health for the
11 purpose of making grants to public or private entities in
12 Illinois for the purpose of funding research concerning breast
13 cancer and for funding services for breast cancer victims. The
14 Department must, before grants are awarded, provide copies of
15 all grant applications to the Ticket For The Cure Board,
16 receive and review the Board's recommendations and comments,
17 and consult with the Board regarding the grants. For purposes
18 of this Section, the term "research" includes, without
19 limitation, expenditures to develop and advance the
20 understanding, techniques, and modalities effective in the
21 detection, prevention, screening, and treatment of breast
22 cancer and may include clinical trials. The grant funds may not
23 be used for institutional, organizational, or community-based
24 overhead costs, indirect costs, or levies.
25     Moneys received for the purposes of this Section,
26 including, without limitation, net revenue from the special

1 instant scratch-off game and gifts, grants, and awards from any
2 public or private entity, must be deposited into the Fund. Any
3 interest earned on moneys in the Fund must be deposited into
4 the Fund.
5     For purposes of this subsection, "net revenue" means the
6 total amount for which tickets have been sold less the sum of
7 the amount paid out in prizes and the actual administrative
8 expenses of the Department solely related to the Ticket For The
9 Cure game.
10     (c) During the time that tickets are sold for the Ticket
11 For The Cure game, the Department shall not unreasonably
12 diminish the efforts devoted to marketing any other instant
13 scratch-off lottery game.
14     (d) The Department may adopt any rules necessary to
15 implement and administer the provisions of this Section.
16     (e) With respect to the changes made by this amendatory Act
17 of the 95th General Assembly, the Department of Human Services
18 is the successor to the Department of Public Health for the
19 purposes of Section 9b of the State Finance Act.

21     Section 10. The Department of Human Services Act is amended
22 by adding Section 10-13 as follows:

24     Sec. 10-13. Ticket For The Cure Board.

1     (a) The Ticket For The Cure Board is created as an advisory
2 board within the Department. The terms of the Board members
3 appointed under Public Act 94-120 terminate on July 1, 2007 and
4 each of those members shall serve only until his or her
5 successor has been appointed and assumes office. The Board
6 consists of 10 members as follows:
7         (1) 2 members appointed by the President of the Senate,
8     one of whom is appointed to serve an initial term of one
9     year and one of whom is appointed to serve an initial term
10     of 2 years;
11         (2) 2 members appointed by the Minority Leader of the
12     Senate, one of whom is appointed to serve an initial term
13     of one year and one of whom is appointed to serve an
14     initial term of 2 years;
15         (3) 2 members appointed by the Speaker of the House of
16     Representatives, one of whom is appointed to serve an
17     initial term of one year and one of whom is appointed to
18     serve an initial term of 2 years;
19         (4) 2 members appointed by the Minority Leader of the
20     House of Representatives, one of whom is appointed to serve
21     an initial term of one year and one of whom is appointed to
22     serve an initial term of 2 years; and
23         (5) 2 members appointed by the Governor with the advice
24     and consent of the Senate, one of whom is appointed to
25     serve an initial term of one year and one of whom is
26     appointed to serve an initial term of 2 years as chair of

1     the Board.
2     After the initial terms, each members shall be appointed to
3 serve a term of 2 years and until his or her successor has been
4 appointed and assumes office. If a vacancy occurs in the Board
5 membership, the vacancy shall be filled in the same manner as
6 the initial appointment.
7     (b) Board members shall serve without compensation but may
8 be reimbursed for their reasonable travel expenses from funds
9 available for that purpose. The Department shall provide staff
10 and administrative support services to the Board.
11     (c) The Board must:
12         (i) consult with the Department of Revenue in designing
13     and promoting the Ticket For The Cure special instant
14     scratch-off lottery game; and
15         (ii) review grant applications, make recommendations
16     and comments, and consult with the Department of Human
17     Services in making grants, from amounts appropriated from
18     the Ticket For The Cure Fund, to public or private entities
19     in Illinois for the purpose of funding research concerning
20     breast cancer and for funding services for breast cancer
21     victims in accordance with Section 21.5 of the Illinois
22     Lottery Law.
23     (d) The Board is discontinued on June 30, 2012.
24     (e) Except for the appointments to the Board under
25 subsection (a), the changes made by this amendatory Act of the
26 95th General Assembly are intended to be a continuation of the

1 Ticket For The Cure Board established in the Department of
2 Public Health under Public Act 94-120. The Department of Human
3 Services is the successor to the Department of Public Health
4 for the purposes of Section 9b of the State Finance Act.

6     Section 15. The Department of Public Health Powers and
7 Duties Law of the Civil Administrative Code of Illinois is
8 amended by repealing Section 2310-347.
 
9     Section 99. Effective date. This Act takes effect upon
10 becoming law.".
