1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Lottery Law is amended by changing
5 Section 21.5 as follows:
 
6     (20 ILCS 1605/21.5)
7     Sec. 21.5. Ticket For The Cure.
8     (a) The Department shall offer a special instant
9 scratch-off game with the title of "Ticket For The Cure". The
10 game shall commence on January 1, 2006 or as soon thereafter,
11 in the discretion of the Director, as is reasonably practical,
12 and shall be discontinued on December 31, 2011. The operation
13 of the game shall be governed by this Act and any rules adopted
14 by the Department. The Department must consult with the Ticket
15 For The Cure Board, which is established under Section 10-13 of
16 the Department of Human Services Act 2310-347 of the Department
17 of Public Health Powers and Duties Law of the Civil
18 Administrative Code of Illinois, regarding the design and
19 promotion of the game. If any provision of this Section is
20 inconsistent with any other provision of this Act, then this
21 Section governs.
22     (b) The Ticket For The Cure Fund is created as a special
23 fund in the State treasury. The net revenue from the Ticket For

1 The Cure special instant scratch-off game shall be deposited
2 into the Fund for appropriation by the General Assembly solely
3 to the Department of Human Services Public Health for the
4 purpose of making grants to public or private entities in
5 Illinois for the purpose of funding research concerning breast
6 cancer and for funding services for breast cancer victims. The
7 Department must, before grants are awarded, provide copies of
8 all grant applications to the Ticket For The Cure Board,
9 receive and review the Board's recommendations and comments,
10 and consult with the Board regarding the grants. At least 50%
11 of the grants awarded from the Fund must be awarded to
12 community-based organizations. For the purposes of this
13 Section, community-based organization" means a private,
14 not-for-profit organization focused on providing social and
15 community development services and on targeting problems
16 within a designated location. For purposes of this Section, the
17 term "research" includes, without limitation, expenditures to
18 develop and advance the understanding, techniques, and
19 modalities effective in the detection, prevention, screening,
20 and treatment of breast cancer and may include clinical trials.
21 The grant funds may not be used for institutional,
22 organizational, or community-based overhead costs, indirect
23 costs, or levies.
24     Moneys received for the purposes of this Section,
25 including, without limitation, net revenue from the special
26 instant scratch-off game and gifts, grants, and awards from any

1 public or private entity, must be deposited into the Fund. Any
2 interest earned on moneys in the Fund must be deposited into
3 the Fund.
4     For purposes of this subsection, "net revenue" means the
5 total amount for which tickets have been sold less the sum of
6 the amount paid out in prizes and the actual administrative
7 expenses of the Department solely related to the Ticket For The
8 Cure game.
9     (c) During the time that tickets are sold for the Ticket
10 For The Cure game, the Department shall not unreasonably
11 diminish the efforts devoted to marketing any other instant
12 scratch-off lottery game.
13     (d) The Department may adopt any rules necessary to
14 implement and administer the provisions of this Section.
15     (e) With respect to the changes made by this amendatory Act
16 of the 95th General Assembly, the Department of Human Services
17 is the successor to the Department of Public Health for the
18 purposes of Section 9b of the State Finance Act.

20     Section 10. The Department of Human Services Act is amended
21 by adding Section 10-13 as follows:

23     Sec. 10-13. Ticket For The Cure Board.
24     (a) The Ticket For The Cure Board is created as an advisory

1 board within the Department. The terms of the Board members
2 appointed under Public Act 94-120 terminate on July 1, 2007 and
3 each of those members shall serve only until his or her
4 successor has been appointed and assumes office. The Board
5 consists of 11 members as follows:
6         (1) 3 members appointed by the President of the Senate,
7     one of whom is appointed to serve an initial term of one
8     year and one of whom is appointed to serve an initial term
9     of 2 years;
10         (2) 2 members appointed by the Minority Leader of the
11     Senate, one of whom is appointed to serve an initial term
12     of one year and one of whom is appointed to serve an
13     initial term of 2 years;
14         (3) 2 members appointed by the Speaker of the House of
15     Representatives, one of whom is appointed to serve an
16     initial term of one year and one of whom is appointed to
17     serve an initial term of 2 years;
18         (4) 2 members appointed by the Minority Leader of the
19     House of Representatives, one of whom is appointed to serve
20     an initial term of one year and one of whom is appointed to
21     serve an initial term of 2 years; and
22         (5) 2 members appointed by the Governor with the advice
23     and consent of the Senate, one of whom is appointed to
24     serve an initial term of one year and one of whom is
25     appointed to serve an initial term of 2 years as chair of
26     the Board.

1     After the initial terms, each member shall be appointed to
2 serve a term of 2 years and until his or her successor has been
3 appointed and assumes office. If a vacancy occurs in the Board
4 membership, the vacancy shall be filled in the same manner as
5 the initial appointment.
6     (b) Board members shall serve without compensation but may
7 be reimbursed for their reasonable travel expenses from funds
8 available for that purpose. The Department shall provide staff
9 and administrative support services to the Board.
10     (c) The Board must:
11         (i) consult with the Department of Revenue in designing
12     and promoting the Ticket For The Cure special instant
13     scratch-off lottery game; and
14         (ii) review grant applications, make recommendations
15     and comments, and consult with the Department of Human
16     Services in making grants, from amounts appropriated from
17     the Ticket For The Cure Fund, to public or private entities
18     in Illinois for the purpose of funding research concerning
19     breast cancer and for funding services for breast cancer
20     victims in accordance with Section 21.5 of the Illinois
21     Lottery Law.
22     (d) The Board is discontinued on June 30, 2012.
23     (e) Except for the appointments to the Board under
24 subsection (a), the changes made by this amendatory Act of the
25 95th General Assembly are intended to be a continuation of the
26 Ticket For The Cure Board established in the Department of

1 Public Health under Public Act 94-120. The Department of Human
2 Services is the successor to the Department of Public Health
3 for the purposes of Section 9b of the State Finance Act.

5     Section 15. The Department of Public Health Powers and
6 Duties Law of the Civil Administrative Code of Illinois is
7 amended by repealing Section 2310-347.
 
8     Section 99. Effective date. This Act takes effect upon
9 becoming law.
