    Amends the Critical Health Problems and Comprehensive Health Education Act. Provides that the school board of each public elementary and secondary school in the State shall require (instead of encourage) all teachers and other school personnel to acquire, develop, and maintain the knowledge and skills necessary to properly administer cardiopulmonary resuscitation. Makes related changes.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Critical Health Problems and Comprehensive
5 Health Education Act is amended by changing Section 3 as
6 follows:
 
7     (105 ILCS 110/3)  (from Ch. 122, par. 863)
8     Sec. 3. Comprehensive Health Education Program. The
9 program established under this Act shall include, but not be
10 limited to, the following major educational areas as a basis
11 for curricula in all elementary and secondary schools in this
12 State: human ecology and health, human growth and development,
13 the emotional, psychological, physiological, hygienic and
14 social responsibilities of family life, including sexual
15 abstinence until marriage, prevention and control of disease,
16 including instruction in grades 6 through 12 on the prevention,
17 transmission and spread of AIDS, public and environmental
18 health, consumer health, safety education and disaster
19 survival, mental health and illness, personal health habits,
20 alcohol, drug use, and abuse including the medical and legal
21 ramifications of alcohol, drug, and tobacco use, abuse during
22 pregnancy, sexual abstinence until marriage, tobacco,
23 nutrition, and dental health. The program shall also provide

1 course material and instruction to advise pupils of the
2 Abandoned Newborn Infant Protection Act. Notwithstanding the
3 above educational areas, the following areas may also be
4 included as a basis for curricula in all elementary and
5 secondary schools in this State: basic first aid (including,
6 but not limited to, cardiopulmonary resuscitation and the
7 Heimlich maneuver), early prevention and detection of cancer,
8 heart disease, diabetes, stroke, and the prevention of child
9 abuse, neglect, and suicide. The school board of each public
10 elementary and secondary school in the State shall require all
11 teachers and other school personnel to acquire, develop, and
12 maintain the knowledge and skills necessary to properly
13 administer cardiopulmonary resuscitation. The school board of
14 each public elementary and secondary school in the State shall
15 encourage all teachers and other school personnel to acquire,
16 develop, and maintain the knowledge and skills necessary to
17 properly administer other life-saving techniques, including
18 without limitation the Heimlich maneuver and rescue breathing.
19 The training shall be in accordance with standards of the
20 American Red Cross, the American Heart Association, or another
21 nationally recognized certifying organization. A school board
22 may use the services of non-governmental entities whose
23 personnel have expertise in life-saving techniques to instruct
24 teachers and other school personnel in these techniques. Each
25 school board is encouraged to have in its employ, or on its
26 volunteer staff, at least one person who is certified, by the

1 American Red Cross or by another qualified certifying agency,
2 as qualified to administer first aid and cardiopulmonary
3 resuscitation. In addition, each school board is authorized to
4 allocate appropriate portions of its institute or inservice
5 days to conduct training programs for teachers and other school
6 personnel who have expressed an interest in becoming qualified
7 to administer emergency first aid or who are required to become
8 qualified to administer cardiopulmonary resuscitation. School
9 boards are urged to encourage their teachers and other school
10 personnel who coach school athletic programs and other
11 extracurricular school activities to acquire, develop, and
12 maintain the knowledge and skills necessary to properly
13 administer first aid and cardiopulmonary resuscitation in
14 accordance with standards and requirements established by the
15 American Red Cross or another qualified certifying agency. No
16 pupil shall be required to take or participate in any class or
17 course on AIDS or family life instruction if his parent or
18 guardian submits written objection thereto, and refusal to take
19 or participate in the course or program shall not be reason for
20 suspension or expulsion of the pupil.
21     Curricula developed under programs established in
22 accordance with this Act in the major educational area of
23 alcohol and drug use and abuse shall include classroom
24 instruction in grades 5 through 12. The instruction, which
25 shall include matters relating to both the physical and legal
26 effects and ramifications of drug and substance abuse, shall be

1 integrated into existing curricula; and the State Board of
2 Education shall develop and make available to all elementary
3 and secondary schools in this State instructional materials and
4 guidelines which will assist the schools in incorporating the
5 instruction into their existing curricula. In addition, school
6 districts may offer, as part of existing curricula during the
7 school day or as part of an after school program, support
8 services and instruction for pupils or pupils whose parent,
9 parents, or guardians are chemically dependent.
