AMENDMENT TO SENATE BILL 843

2     AMENDMENT NO. ______. Amend Senate Bill 843 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Counties Code is amended by changing
5 Section 5-1062.1 as follows:
 
6     (55 ILCS 5/5-1062.1)  (from Ch. 34, par. 5-1062.1)
7     Sec. 5-1062.1. Stormwater management planning councils in
8 Cook County.
9     (a) Stormwater management in Cook County shall be conducted
10 as provided in Section 7h of the Metropolitan Water Reclamation
11 District Act. As used in this Section, "District" means the
12 Metropolitan Water Reclamation District of Greater Chicago.
13     The purpose of this Section is to create planning councils,
14 organized by watershed, to contribute to the stormwater
15 management process by advising the Metropolitan Water
16 Reclamation District of Greater Chicago and representing the
17 needs and interests of the members of the public and the local
18 governments included within their respective watersheds.
19     (b) Stormwater management planning councils shall be
20 formed for each of the following established watersheds of the
21 Chicago Metropolitan Area: North Branch Chicago River, Lower
22 Des Plaines Tributaries, Cal-Sag Channel, Little Calumet
23 River, Poplar Creek, and Upper Salt Creek. In addition a
24 stormwater management planning council shall be established

1 for the combined sewer areas of Cook County. Additional
2 stormwater management planning councils may be formed by the
3 District for other watersheds within Cook County. Membership on
4 the watershed councils shall consist of the chief elected
5 official, or his or her designee, from each municipality and
6 township within the watershed and the Cook County Board
7 President, or his or her designee, if unincorporated area is
8 included in the watershed. A municipality or township shall be
9 a member of more than one watershed council if the corporate
10 boundaries of that municipality or township extend into more
11 than one watershed, or if the municipality or township is
12 served in part by separate sewers and combined sewers.
13 Subcommittees of the stormwater management planning councils
14 may be established to assist the stormwater management planning
15 councils in performing their duties. The councils may adopt
16 bylaws to govern the functioning of the stormwater management
17 councils and subcommittees.
18     (c) The principal duties of the watershed planning councils
19 shall be to advise the District on the development and
20 implementation of the countywide stormwater management plan
21 with respect to matters relating to their respective watersheds
22 and to advise and represent the concerns of the units of local
23 government in the watershed area. The councils shall meet at
24 least quarterly and shall hold at least one public hearing
25 during the preparation of the plan.
26     (d) The District shall give careful consideration to the
27 recommendations and concerns of the watershed planning
28 councils throughout the planning process and shall coordinate
29 the 6 watershed plans as developed and to coordinate the
30 planning process with the adjoining counties to ensure that
31 recommended stormwater projects will have no significant
32 adverse impact on the levels or flows of stormwater in the
33 inter-county watershed or on the capacity of existing and
34 planned stormwater retention facilities. The District shall

1 include cost benefit analysis in its deliberations and in
2 evaluating priorities for projects from watershed to
3 watershed. The District shall identify in an annual published
4 report steps taken by the District to accommodate the concerns
5 and recommendations of the watershed planning councils.
6     (e) The stormwater management planning councils may
7 recommend rules and regulations to the District governing the
8 location, width, course, and release rates of all stormwater
9 runoff channels, streams, and basins in their respective
10 watersheds.
11     (f) The Northwest Municipal Conference, the South Suburban
12 Mayors and Managers Association, the Southwest Conference of
13 Mayors, and the West Central Municipal Conference shall be
14 responsible for the coordination of the planning councils
15 created under this Section.

17     Section 99. Effective date. This Act takes effect upon
18 becoming law.".
