1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Counties Code is amended by changing Section
5 5-1062.1 as follows:
 
6     (55 ILCS 5/5-1062.1)  (from Ch. 34, par. 5-1062.1)
7     Sec. 5-1062.1. Stormwater management planning councils in
8 Cook County.
9     (a) Stormwater management in Cook County shall be conducted
10 as provided in Section 7h of the Metropolitan Water Reclamation
11 District Act. As used in this Section, "District" means the
12 Metropolitan Water Reclamation District of Greater Chicago.
13     The purpose of this Section is to create planning councils,
14 organized by watershed, to contribute to the stormwater
15 management process by advising the Metropolitan Water
16 Reclamation District of Greater Chicago and representing the
17 needs and interests of the members of the public and the local
18 governments included within their respective watersheds.
19     (b) Stormwater management planning councils shall be
20 formed for each of the following established watersheds of the
21 Chicago Metropolitan Area: North Branch Chicago River, Lower
22 Des Plaines Tributaries, Cal-Sag Channel, Little Calumet
23 River, Poplar Creek, and Upper Salt Creek. In addition a
24 stormwater management planning council shall be established
25 for the combined sewer areas of Cook County. Additional
26 stormwater management planning councils may be formed by the
27 District for other watersheds within Cook County. Membership on
28 the watershed councils shall consist of the chief elected
29 official, or his or her designee, from each municipality and
30 township within the watershed and the Cook County Board
31 President, or his or her designee, if unincorporated area is
32 included in the watershed. A municipality or township shall be

1 a member of more than one watershed council if the corporate
2 boundaries of that municipality or township extend into more
3 than one watershed, or if the municipality or township is
4 served in part by separate sewers and combined sewers.
5 Subcommittees of the stormwater management planning councils
6 may be established to assist the stormwater management planning
7 councils in performing their duties. The councils may adopt
8 bylaws to govern the functioning of the stormwater management
9 councils and subcommittees.
10     (c) The principal duties of the watershed planning councils
11 shall be to advise the District on the development and
12 implementation of the countywide stormwater management plan
13 with respect to matters relating to their respective watersheds
14 and to advise and represent the concerns of the units of local
15 government in the watershed area. The councils shall meet at
16 least quarterly and shall hold at least one public hearing
17 during the preparation of the plan.
18     (d) The District shall give careful consideration to the
19 recommendations and concerns of the watershed planning
20 councils throughout the planning process and shall coordinate
21 the 6 watershed plans as developed and to coordinate the
22 planning process with the adjoining counties to ensure that
23 recommended stormwater projects will have no significant
24 adverse impact on the levels or flows of stormwater in the
25 inter-county watershed or on the capacity of existing and
26 planned stormwater retention facilities. The District shall
27 include cost benefit analysis in its deliberations and in
28 evaluating priorities for projects from watershed to
29 watershed. The District shall identify in an annual published
30 report steps taken by the District to accommodate the concerns
31 and recommendations of the watershed planning councils.
32     (e) The stormwater management planning councils may
33 recommend rules and regulations to the District governing the
34 location, width, course, and release rates of all stormwater
35 runoff channels, streams, and basins in their respective
36 watersheds.

1     (f) The Northwest Municipal Conference, the South Suburban
2 Mayors and Managers Association, the Southwest Conference of
3 Mayors, and the West Central Municipal Conference shall be
4 responsible for the coordination of the planning councils
5 created under this Section.
