1     AN ACT concerning State government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Parks Designation Act is amended by
5 changing Section 1 as follows:
 
6     (20 ILCS 840/1)  (from Ch. 105, par. 468g)
7     Sec. 1. The following described areas are designated State
8 Parks and have the names herein ascribed to them:
9     Adeline Jay Geo-Karis Illinois Beach State Park, in Lake
10 County;

30 Natural Resources from the operation of the marina to be

33 including slip rentals, concession leases, and ground rents,

1 shall be deposited into a special fund known as the Adeline Jay
2 Geo-Karis Illinois Beach Marina Fund, which is hereby created
3 in the State Treasury. All interest earned on monies in this
4 Fund shall remain in the Fund.

7     Sec. 8.25c. (a) Beginning in fiscal year 1991 and
8 continuing through the third quarter of fiscal year 1993, the
9 State Comptroller shall order transferred and the State
10 Treasurer shall transfer from the Illinois Beach Marina Fund
11 (now known as the Adeline Jay Geo-Karis Illinois Beach Marina
12 Fund) to the General Revenue Fund 50% of the revenue deposited
13 into the Illinois Beach Marina Fund. Beginning in the fourth
14 quarter of fiscal year 1993 and thereafter until the sum of
15 $31,200,000 is paid to the General Revenue Fund, the State
16 Comptroller shall order transferred and the State Treasurer
17 shall transfer from the Adeline Jay Geo-Karis Illinois Beach
18 Marina Fund (formerly known as the Illinois Beach Marina Fund)
19 to the General Revenue Fund 25% of the first $2,000,000 of
20 revenue deposited into the Adeline Jay Geo-Karis Illinois Beach
21 Marina Fund (formerly known as the Illinois Beach Marina Fund)
22 in any fiscal year, and 75% of the revenue deposited into the
23 Adeline Jay Geo-Karis Illinois Beach Marina Fund (formerly
24 known as the Illinois Beach Marina Fund) in excess of
25 $2,000,000 in any fiscal year; however, such transfers shall
26 not exceed $2,000,000 in any fiscal year. In addition,
27 beginning in fiscal year 1991 and thereafter until the sum of
28 $8,000,000 is paid to the State Boating Act Fund the State
29 Comptroller shall order transferred and the State Treasurer
30 shall transfer from the Adeline Jay Geo-Karis Illinois Beach
31 Marina Fund (formerly known as the Illinois Beach Marina Fund)
32 to the State Boating Act Fund 15% of the revenue deposited into
33 the Adeline Jay Geo-Karis Illinois Beach Marina Fund (formerly
34 known as the Illinois Beach Marina Fund). Beginning in fiscal
35 year 1992, the transfers from the Adeline Jay Geo-Karis

1 Illinois Beach Marina Fund (formerly known as the Illinois
2 Beach Marina Fund) to the State Boating Act Fund shall be made
3 only at the direction of and in the amount authorized by the
4 Department of Natural Resources. Moneys transferred under
5 authorization of this Section to the State Boating Act Fund in
6 fiscal year 1992 before the effective date of this amendatory
7 Act of 1991 may be transferred to the Illinois Beach Marina
8 Fund (now known as the Adeline Jay Geo-Karis Illinois Beach
9 Marina Fund) at the direction of the Department of Natural
10 Resources. The transfers required under this Section shall be
11 made within 30 days after the end of each quarter based on the
12 State Comptroller's record of receipts for the quarter. The
13 initial transfers shall be made within 30 days after June 30,
14 1990 based on revenues received in the preceding quarter.
15 Additional transfers in excess of the limits established under
16 this Section may be authorized by the Department of Natural
17 Resources for accelerated payback of the amount due.
18     (b) The Department may, subject to appropriations by the
19 General Assembly, use monies in the Adeline Jay Geo-Karis
20 Illinois Beach Marina Fund (formerly known as the Illinois
21 Beach Marina Fund) to pay for operation, maintenance, repairs,
22 or improvements to the marina project; provided, however, that
23 payment of the amounts due under the terms of subsection (a)
24 shall have priority on all monies deposited in this Fund.
25     (c) Monies on deposit in excess of that needed for payments
26 to the General Revenue Fund and the State Boating Fund and in
27 excess of those monies needed for the operation, maintenance,
28 repairs, or improvements to the Adeline Jay Geo-Karis Illinois
29 Beach Marina as determined by the Department of Natural
30 Resources may be transferred at the discretion of the
31 Department to the State Parks Fund.

19     All of these transfers shall be made in equal quarterly
20 installments with the first made on the effective date of this
21 amendatory Act of the 94th General Assembly, or as soon
22 thereafter as practical, and with the remaining transfers to be
23 made on October 1, January 1, and April 1, or as soon
24 thereafter as practical. These transfers shall be made
25 notwithstanding any other provision of State law to the
26 contrary.
27     (b) On and after the effective date of this amendatory Act
28 of the 94th General Assembly through June 30, 2006, when any of
29 the funds listed in subsection (a) have insufficient cash from
30 which the State Comptroller may make expenditures properly
31 supported by appropriations from the fund, then the State
32 Treasurer and State Comptroller shall transfer from the General
33 Revenue Fund to the fund only such amount as is immediately
34 necessary to satisfy outstanding expenditure obligations on a
35 timely basis, subject to the provisions of the State Prompt
36 Payment Act. Any amounts transferred from the General Revenue

1 Fund to a fund pursuant to this subsection (b) from time to
2 time shall be re-transferred by the State Comptroller and the
3 State Treasurer from the receiving fund into the General
4 Revenue Fund as soon as and to the extent that deposits are
5 made into or receipts are collected by the receiving fund. In
6 all events, the full amounts of all transfers from the General
7 Revenue Fund to receiving funds shall be re-transferred to the
8 General Revenue Fund no later than June 30, 2006.
9     (c) Notwithstanding any other provision of law, on July 1,
10 2005, or as soon thereafter as may be practical, the State
11 Comptroller and the State Treasurer shall transfer $5,000,000
12 from the Communications Revolving Fund to the Hospital Basic
13 Services Prevention Fund.
