1     AN ACT concerning insurance.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Insurance Code is amended by
5 changing Section 356u as follows:
 
6     (215 ILCS 5/356u)
7     Sec. 356u. Pap tests and prostate-specific antigen tests.
8     (a) A group policy of accident and health insurance that
9 provides coverage for hospital or medical treatment or services
10 for illness on an expense-incurred basis and is amended,
11 delivered, issued, or renewed after the effective date of this
12 amendatory Act of 1997 shall provide coverage for all of the
13 following:
14         (1) An annual cervical smear or Pap smear test for
15     female insureds.
16         (2) An annual digital rectal examination and a
17     prostate-specific antigen test, for male insureds upon the
18     recommendation of a physician licensed to practice
19     medicine in all its branches for:
20             (A) asymptomatic men age 50 and over;
21             (B) African-American men age 40 and over; and
22             (C) men age 40 and over with a family history of
23         prostate cancer.
24         (3) Surveillance tests for ovarian cancer for female
25     insureds who are at risk for ovarian cancer.
26     (b) This Section shall not apply to agreements, contracts,
27 or policies that provide coverage for a specified disease or
28 other limited benefit coverage.
29     (c) For the purposes of this Section:
30     "At risk for ovarian cancer" means:
31         (1) having a family history (i) with one or more
32     first-degree relatives with ovarian cancer, (ii) of

1     clusters of women relatives with breast cancer, or (iii) of
2     nonpolyposis colorectal cancer; or
3         (2) testing positive for BRCA1 or BRCA2 mutations.
4     "Surveillance tests for ovarian cancer" means annual
5 screening using (i) CA-125 serum tumor marker testing, (ii)
6 transvaginal ultrasound, (iii) pelvic examination.

8     Section 99. Effective date. This Act takes effect January
9 1, 2006.
