AMENDMENT TO SENATE BILL 91

2     AMENDMENT NO. ______. Amend Senate Bill 91, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Mobile Home Park Act is amended by adding
6 Sections 2.7a and 2.7b and changing Sections 9.3, 9.9, 9.10,
7 and 26 as follows:
 
8     (210 ILCS 115/2.7a new)
9     Sec. 2.7a. "Existing site" means a parcel of land for the
10 accommodation of a mobile home constructed before the effective
11 date of this amendatory Act of the 94th General Assembly and
12 built in conformance with the standards in effect at the time
13 the site was originally constructed.

15     Sec. 2.7b. "New site" means a parcel of land for the
16 accommodation of a mobile home constructed on or after the
17 effective date of this amendatory Act of the 94th General
18 Assembly.

20     Sec. 9.3. Minimum sites; access.
21     (a) Each site on which a mobile home is accommodated shall
22 have a minimum area of 2,500 square feet, provided that sites

1 existing in parks or approved by the Department for
2 construction prior to August 21, 1967, shall contain an area of
3 not less than 1,000 square feet, and sites constructed between
4 August 21, 1967 and September 18, 1987 the effective date of
5 this amendatory Act of 1987 shall contain an area of not less
6 than 2,100 feet.
7     (b) No mobile home shall be parked closer than 5 feet to
8 the side lot lines of a park, or closer than 10 feet to a public
9 street, alley, or building. Each individual site shall abut or
10 face on a private or public street. All streets shall have
11 unobstructed access to a public street.
12     On or after the effective date of this amendatory Act of
13 the 94th General Assembly, no mobile home shall be parked
14 closer than 5 feet to the side lot lines of a park, or closer
15 than 10 feet to a public or private street, alley or building.
16 Each individual site shall abut or face on a private or public
17 street. All streets shall have unobstructed access to a public
18 street of not less than 24 feet in width.
19     (c) There shall be an open space of of 3 meters (10 feet)
20 side-to-side, 2.4 meters (8 feet) end-to-side, or 1.8 meters (6
21 feet) end-to-end horizontally between mobile homes or
22 community buildings. The exposed composite walls and roof of
23 both structures shall be constructed of materials that will
24 provide a one-hour fire resistance rating, or there shall be a
25 separation barrier between the structures that provides a
26 one-hour fire resistance rating. Whenever an owner of a mobile
27 home community enlarges or expands a concrete pad used to
28 support a mobile home, installs a new mobile home, or replaces
29 an existing mobile home on or after the effective date of this
30 amendatory Act of the 94th General Assembly, the placement of
31 the mobile home must comply with the setback requirements of
32 this Section at least 10 feet adjacent to the sides of every
33 mobile home and at least 5 feet adjacent to the ends of every
34 mobile home.

1     (d) When a mobile home is removed from an existing site and
2 then returned to the existing site or when a mobile home on an
3 existing site is removed from the site and replaced by another
4 mobile home on the existing site, the existing site shall not
5 be deemed to be a new site and shall be governed by the
6 standards in effect at the time the site was originally
7 constructed.
8     (e) A home rule unit other than a home rule municipality
9 with a population greater than 1,000,000 may not regulate new
10 or existing mobile home sites, as defined in this Act, with
11 respect to setback and separation requirements or minimum
12 square-footage standards in a manner that conflicts with this
13 Section. This subsection is a limitation under subsection (i)
14 of Section 6 of Article VII of the Illinois Constitution on the
15 concurrent exercise by home rule units of powers and functions
16 exercised by the State.

19     Sec. 9.9. Fire extinguishers; smoke and carbon monoxide
20 detectors.
21     (a) Mobile homes in mobile home parks shall each be
22 equipped with the following:
23         (1) Fire fire extinguishers in working order, one in
24     each end of the mobile home.
25         (2) A smoke detector, in working order, in each bedroom
26     in the mobile home, in accordance with standards approved
27     by the State Fire Marshal.
28         (3) A carbon monoxide detector in working order, in
29     accordance with standards approved by the State Fire
30     Marshal.
31     The changes made to this subsection (a) by this amendatory
32 Act of the 94th General Assembly apply on and after the date
33 that occurs one year after this amendatory Act of the 94th

1 General Assembly becomes law.
2     (b) The space under a manufactured home may not be used for
3 the storage of combustible materials or for the storage or
4 placement of flammable liquids, gases, or liquid-fuel-powered
5 or gas-fuel-powered equipment.
6     (c) Inspection of any such equipment and enforcement of any
7 Rules and Regulations adopted pursuant to this Section
8 paragraph shall be the duty of the State Fire Marshall and
9 local law enforcement agencies in the county or municipality
10 where the mobile home park is located.

13     Sec. 9.10. Porches, carports, garages, accessory
14 buildings, sheds, awnings, skirting, and auxiliary rooms shall
15 be constructed of materials specified by regulations adopted by
16 the Department or by the municipality in which the mobile home
17 park is located or, if the mobile home park is not located in a
18 municipality, by the county in which the mobile home park is
19 located.

23 limits of any home rule unit, except as otherwise provided in
24 this Act.
