SYNOPSIS AS INTRODUCED:
 
105 ILCS 230/5-30

    Amends the School Construction Law. Provides that the State Board of Education shall rank school districts based on certain school construction priorities and notify each school district of its rank. Provides that the Commission on Government Forecasting and Accountability may take whatever actions are necessary to determine whether the State Board of Education is complying with this amendatory Act. Effective immediately.

1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Construction Law is amended by
5 changing Section 5-30 as follows:
 
6     (105 ILCS 230/5-30)
7     Sec. 5-30. Priority of school construction projects. The
8 State Board of Education shall develop standards for the
9 determination of priority needs concerning school construction
10 projects based upon approved district facilities plans. Such
11 standards shall call for prioritization based on the degree of
12 need and project type in the following order:
13         (1) Replacement or reconstruction of school buildings
14     destroyed or damaged by flood, tornado, fire, earthquake,
15     or other disasters, either man-made or produced by nature;
16         (2) Projects designed to alleviate a shortage of
17     classrooms due to population growth or to replace aging
18     school buildings;
19         (3) Projects resulting from interdistrict
20     reorganization of school districts contingent on local
21     referenda;
22         (4) Replacement or reconstruction of school facilities
23     determined to be severe and continuing health or life
24     safety hazards;
25         (5) Alterations necessary to provide accessibility for
26     qualified individuals with disabilities; and
27         (6) Other unique solutions to facility needs.
28 The State Board of Education may not make any material changes
29 to the standards in effect on May 18, 2004, unless the State
30 Board of Education is specifically authorized by law.
31     The State Board of Education shall rank school districts
32 based on the priorities listed in this Section and notify each

1 school district of its rank on or before December 31, 2006. The
2 Commission on Government Forecasting and Accountability may
3 take whatever actions are necessary to determine whether the
4 State Board of Education is complying with this amendatory Act
5 of the 94th General Assembly.

7     Section 99. Effective date. This Act takes effect upon
8 becoming law.
