    Amends the Employee Benefit Contribution Act. Makes a technical change in a Section concerning the failure to make payments to an employee health insurance plan.

1     AN ACT concerning employment.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Employee Benefit Contribution Act is amended
5 by changing Section 2 as follows:
 
6     (820 ILCS 160/2)  (from Ch. 48, par. 39x)
7     Sec. 2. Any employer who has agreed to make payments to an
8 employee health insurance plan shall notify its employees of
9 any failure to make such payments where such failure shall
10 result in the the total loss of insurance coverage so as to
11 provide its employees a reasonable opportunity to replace such
12 coverage at the time the employee health insurance plan
13 terminates. The employer must provide written notification
14 directly to each of its employees who are covered under the
15 plan. Any employer who fails to provide timely notice of a
16 prospective termination of a health insurance plan, which
17 failure results in the deprivation of the opportunity to
18 replace such coverage and which further results in damages to
19 one or more employees arising from the loss of coverage, shall
20 be guilty of a Class B misdemeanor.
