AMENDMENT TO HOUSE BILL 1412

2     AMENDMENT NO. ______. Amend House Bill 1412 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The State Finance Act is amended by adding
5 Section 5.640 as follows:
 
6     (30 ILCS 105/5.640 new)
7     Sec. 5.640. The Professional Sports Teams Charity Fund.
 
8     Section 10. The Illinois Vehicle Code is amended by
9 changing and renumbering Section 3-654, as added by Public Act
10 92-699, as follows:
 
11     (625 ILCS 5/3-658)
12     Sec. 3-658 3-654. Professional Sports Teams license
13 plates.
14     (a) The Secretary, upon receipt of an application made in
15 the form prescribed by the Secretary, may issue special
16 registration plates designated as Professional Sports Teams
17 license plates. The special plates issued under this Section
18 shall be affixed only to passenger vehicles of the first
19 division and motor vehicles of the second division weighing not
20 more than 8,000 pounds. Plates issued under this Section shall
21 expire according to the multi-year procedure established by
22 Section 3-414.1 of this Code.

1     (b) The design and color of the plates is wholly within the
2 discretion of the Secretary, except that the plates shall,
3 subject to the permission of the applicable team owner, display
4 the logo of the Chicago Bears, the Chicago Bulls, the Chicago
5 Blackhawks Black Hawks, the Chicago Cubs, the Chicago White
6 Sox, the St. Louis Rams, or the St. Louis Cardinals, at the
7 applicant's option. The Secretary may allow the plates to be
8 issued as vanity or personalized plates under Section 3-405.1
9 of the Code. The Secretary shall prescribe stickers or decals
10 as provided under Section 3-412 of this Code.
11     (c) An applicant for the special plate shall be charged a
12 $40 fee for original issuance in addition to the appropriate
13 registration fee. Of this fee, $15 $25 shall be deposited into
14 the Professional Sports Teams Education Fund, $10 shall be
15 deposited into the Professional Sports Teams Charity Fund, and
16 $15 shall be deposited into the Secretary of State Special
17 License Plate Fund, to be used by the Secretary to help defray
18 the administrative processing costs.
19     For each registration renewal period, a $27 fee, in
20 addition to the appropriate registration fee, shall be charged.
21 Of this fee, $15 $25 shall be deposited into the Professional
22 Sports Teams Education Fund, $10 shall be deposited into the
23 Professional Sports Teams Charity Fund, and $2 shall be
24 deposited into the Secretary of State Special License Plate
25 Fund.
26     (d) The Professional Sports Teams Education Fund is created
27 as a special fund in the State treasury. All moneys in the
28 Professional Sports Teams Education Fund shall, subject to
29 appropriation by the General Assembly and approval by the
30 Secretary, be deposited every 6 months into the Common School
31 Fund.
32     (e) Professional Sports Teams Charity Fund.
33         (1) The Professional Sports Teams Charity Fund is
34     created as a special fund in the State treasury.

1         (2) If the owner of a team listed in subsection (b)
2     submits to the Secretary its designation of a charitable
3     organization that is tax-exempt under Section 501(c)(3) of
4     the Internal Revenue Code and is associated with that team
5     or has a particular fund within the charitable organization
6     that is associated with that team, the Secretary shall
7     notify the State Treasurer accordingly and the State
8     Treasurer shall create a separate account within the
9     Professional Sports Teams Charity Fund for that team. When
10     the Secretary receives fees for plates displaying the logo
11     of that team, the Secretary shall notify the State
12     Treasurer accordingly and the State Treasurer shall keep
13     the fees deposited into the Professional Sports Teams
14     Charity Fund for those plates within the separate account
15     for that team. All moneys in the separate account shall,
16     subject to appropriation by the General Assembly and
17     approval by the Secretary, be paid as grants to the
18     designated charitable organization for the purposes of the
19     charitable organization or the purposes of the particular
20     fund within the charitable organization, as the case may
21     be.
22         (3) The State Treasurer shall create a Common School
23     Fund account within the Professional Sports Teams Charity
24     Fund. When the Secretary receives fees for plates
25     displaying the logo of a team listed in subsection (b) and
26     the owner of that team has not submitted to the Secretary
27     its designation of a charitable organization in accordance
28     with paragraph (2), the Secretary shall notify the State
29     Treasurer accordingly and the State Treasurer shall keep
30     the fees deposited into the Professional Sports Teams
31     Charity Fund for those plates within the Common School Fund
32     account. All moneys in the Common School Fund account
33     shall, subject to appropriation by the General Assembly and
34     approval by the Secretary, be deposited every 6 months into
