 1                       SENATE JOINT RESOLUTION
 2                      CONSTITUTIONAL AMENDMENT

 3        RESOLVED,  BY  THE  SENATE  OF  THE  NINETY-THIRD GENERAL
 4    ASSEMBLY  OF  THE   STATE   OF   ILLINOIS,   THE   HOUSE   OF
 5    REPRESENTATIVES   CONCURRING  HEREIN,  that  there  shall  be
 6    submitted to the  electors  of  the  State  for  adoption  or
 7    rejection  at  the general election next occurring at least 6
 8    months after the adoption of this resolution a proposition to
 9    amend Article V of  the  Illinois  Constitution  by  changing
10    Sections  1,  3,  7,  and  18  and by repealing Section 17 as
11    follows:

12                              ARTICLE V
13                            THE EXECUTIVE

14        (ILCON Art. V, Sec. 1)
15    SECTION 1. OFFICERS
16        The Executive Branch shall include a Governor, Lieutenant
17    Governor,  Attorney  General,   Secretary   of   State,   and
18    Comptroller of the Treasury Comptroller and Treasurer elected
19    by  the  electors  of  the  State. They shall keep the public
20    records and maintain a residence at the  seat  of  government
21    during their terms of office.

24    SECTION 3. ELIGIBILITY
25        To be eligible to hold the office of Governor, Lieutenant
26    Governor,   Attorney   General,   Secretary   of   State,  or
27    Comptroller of  the  Treasury  Comptroller  or  Treasurer,  a
28    person  must  be  a  United States citizen, at least 25 years
29    old, and a  resident  of  this  State  for  the  three  years
30    preceding his or her election.

 1        (ILCON Art. V, Sec. 7)
 2    SECTION 7. VACANCIES IN OTHER ELECTIVE OFFICES
 3        If   the   Attorney   General,  Secretary  of  State,  or
 4    Comptroller of the Treasury Comptroller or Treasurer fails to
 5    qualify or if the his office  becomes  vacant,  the  Governor
 6    shall  fill  the  office  by appointment. The appointee shall
 7    hold office until the elected officer qualifies  or  until  a
 8    successor  is elected and qualified as may be provided by law
 9    and shall not be subject to removal by the Governor.  If  the
10    Lieutenant  Governor  fails  to  qualify or if the his office
11    becomes vacant, it shall remain vacant until the end  of  the
12    term.

14        (ILCON Art. V, Sec. 17)
15    SECTION 17. COMPTROLLER - DUTIES (REPEALED)
16        The  Comptroller,  in accordance with law, shall maintain
17    the State's central fiscal accounts, and order payments  into
18    and out of the funds held by the Treasurer.

21    SECTION 18. COMPTROLLER OF THE TREASURY TREASURER - DUTIES
22        The  Comptroller of the Treasury Treasurer, in accordance
23    with law, shall  (i)  maintain  the  State's  central  fiscal
24    accounts,  and  order payments into and out of the funds held
25    by him or her, (ii)  be responsible for the  safekeeping  and
26    investment  of  monies  and  securities deposited with him or
27    her, and for their disbursement upon his or  her  order,  and
28    (iii)  have  the  duties and powers that may be prescribed by
29    law of the Comptroller.

 1        A Comptroller of the Treasury, but not a  Comptroller  or
 2    Treasurer,  shall  be  elected  in 2010 and thereafter.  This
 3    Constitutional Amendment  otherwise  takes  effect  upon  the
 4    conclusion  of the terms of the Comptroller and the Treasurer
 5    elected in 2006.
