AMENDMENT TO SENATE BILL 3207

2     AMENDMENT NO. ______. Amend Senate Bill 3207 by replacing
3 everything after the enacting clause with the following:
 
 
4     "Section 5. The Asbestos Abatement Authority Act is amended
5 by changing Sections 4 and 5 as follows:
 
6     (20 ILCS 3120/4)  (from Ch. 127, par. 3504)
7     Sec. 4. Environmental Enforcement-Asbestos Litigation
8 Division. There is created within the office of the Attorney
9 General an Environmental Enforcement-Asbestos Litigation
10 Division. The Division, under the supervision and the direction
11 of the Attorney General, shall enforce laws, rules, and
12 regulations that protect the State's environment and shall
13 investigate and initiate legal proceedings necessary to ensure
14 maximum recovery of asbestos abatement costs for all State
15 entities of this State. All asbestos abatement costs amounts
16 recovered by the Division, including any award of damages,
17 penalties, those awarded for asbestos abatement and attorney's
18 fees, shall be deposited in the Asbestos Abatement Fund in the
19 State Treasury.

1 State Treasury the Asbestos Abatement Fund into which shall be
2 deposited all grants, gifts, attorney's fees and recoveries
3 received for the purpose of asbestos abatement in the State
4 governmental buildings. Such funds shall be expended pursuant
5 to appropriations made by the General Assembly to the Capital
6 Development Board for asbestos surveys and abatement purposes
7 and to the Attorney General for the operations of the
8 Environmental Enforcement-Asbestos Litigation Division.

10     Section 99. Effective date. This Act takes effect upon
11 becoming law.".
