SYNOPSIS AS INTRODUCED:

    Amends the Asbestos Abatement Authority Act. Renames the Attorney General's Asbestos Litigation Division as the Environmental Enforcement-Asbestos Litigation Division. Effective immediately.

1     AN ACT concerning the Attorney General
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Asbestos Abatement Authority Act is amended
5 by changing Sections 4 and 5 as follows:
 
6     (20 ILCS 3120/4)  (from Ch. 127, par. 3504)
7     Sec. 4. Environmental Enforcement-Asbestos Litigation
8 Division. There is created within the office of the Attorney
9 General an Environmental Enforcement-Asbestos Litigation
10 Division. The Division, under the supervision and the direction
11 of the Attorney General, shall investigate and initiate legal
12 proceedings necessary to ensure maximum recovery of asbestos
13 abatement costs for all State entities of this State. All
14 amounts recovered by the Division, including those awarded for
15 asbestos abatement and attorney's fees, shall be deposited in
16 the Asbestos Abatement Fund in the State Treasury.

19     Sec. 5. Asbestos Abatement Fund. There is created in the
20 State Treasury the Asbestos Abatement Fund into which shall be
21 deposited all grants, gifts, attorney's fees and recoveries
22 received for the purpose of asbestos abatement in the State
23 governmental buildings. Such funds shall be expended pursuant
24 to appropriations made by the General Assembly to the Capital
25 Development Board for asbestos surveys and abatement purposes
26 and to the Attorney General for the operations of the
27 Environmental Enforcement-Asbestos Litigation Division.

29     Section 99. Effective date. This Act takes effect upon
30 becoming law.
