AMENDMENT TO SENATE BILL 3192

2     AMENDMENT NO. ______. Amend Senate Bill 3192 by replacing
3 the title with the following:
4     "AN ACT concerning schools."; and
 
5 by replacing everything after the enacting clause with the
6 following:
 
7     "Section 5. The School Breakfast and Lunch Program Act is
8 amended by adding Section 3.5 as follows:
 
9     (105 ILCS 125/3.5 new)
10     Sec. 3.5. Publication of lunch menu. A school board that
11 does any one of the following must publish the school lunch
12 menu and the nutrition content, including calories, of each
13 meal item:
14         (1) Completes a nutritional analysis of traditional or
15     enhanced food-based menu plans as part of the State review
16     process.
17         (2) Provides its meals under a nutrient-based menu
18     plan.
19         (3) Utilizes software that calculates the nutritional
20     content of foods or menus.
21 All other school boards are strongly encouraged to publish the
22 school lunch menu and the nutrition content, including
23 calories, of each meal item.

1     A school board may determine the frequency and manner of
2 publication.
 
3     Section 10. The Critical Health Problems and Comprehensive
4 Health Education Act is amended by changing Section 3 as
5 follows:
 
6     (105 ILCS 110/3)  (from Ch. 122, par. 863)
7     Sec. 3. Comprehensive Health Education Program. The
8 program established under this Act shall include, but not be
9 limited to, the following major educational areas as a basis
10 for curricula in all elementary and secondary schools in this
11 State: human ecology and health, human growth and development,
12 the emotional, psychological, physiological, hygienic and
13 social responsibilities of family life, including sexual
14 abstinence until marriage, prevention and control of disease,
15 including instruction in grades 6 through 12 on the prevention,
16 transmission and spread of AIDS, public and environmental
17 health, consumer health, safety education and disaster
18 survival, mental health and illness (including instruction in
19 secondary schools on clinical depression and suicide
20 prevention), personal health habits, alcohol, drug use, and
21 abuse including the medical and legal ramifications of alcohol,
22 drug, and tobacco use, abuse during pregnancy, sexual
23 abstinence until marriage, tobacco, nutrition, and dental
24 health. Notwithstanding the above educational areas, the
25 following areas may also be included as a basis for curricula
26 in all elementary and secondary schools in this State: basic
27 first aid (including, but not limited to, cardiopulmonary
28 resuscitation and the Heimlich maneuver), early prevention and
29 detection of cancer, heart disease, diabetes, stroke, and the
30 prevention of child abuse, neglect, and suicide. The school
31 board of each public elementary and secondary school in the
32 State shall encourage all teachers and other school personnel

1 to acquire, develop, and maintain the knowledge and skills
2 necessary to properly administer life-saving techniques,
3 including without limitation the Heimlich maneuver and rescue
4 breathing. The training shall be in accordance with standards
5 of the American Red Cross, the American Heart Association, or
6 another nationally recognized certifying organization. A
7 school board may use the services of non-governmental entities
8 whose personnel have expertise in life-saving techniques to
9 instruct teachers and other school personnel in these
10 techniques. Each school board is encouraged to have in its
11 employ, or on its volunteer staff, at least one person who is
12 certified, by the American Red Cross or by another qualified
13 certifying agency, as qualified to administer first aid and
14 cardiopulmonary resuscitation. In addition, each school board
15 is authorized to allocate appropriate portions of its institute
16 or inservice days to conduct training programs for teachers and
17 other school personnel who have expressed an interest in
18 becoming qualified to administer emergency first aid or
19 cardiopulmonary resuscitation. School boards are urged to
20 encourage their teachers and other school personnel who coach
21 school athletic programs and other extracurricular school
22 activities to acquire, develop, and maintain the knowledge and
23 skills necessary to properly administer first aid and
24 cardiopulmonary resuscitation in accordance with standards and
25 requirements established by the American Red Cross or another
26 qualified certifying agency. No pupil shall be required to take
27 or participate in any class or course on AIDS or family life
28 instruction if his parent or guardian submits written objection
29 thereto, and refusal to take or participate in the course or
30 program shall not be reason for suspension or expulsion of the
31 pupil.
32     Curricula developed under programs established in
33 accordance with this Act in the major educational area of
34 alcohol and drug use and abuse shall include classroom

1 instruction in grades 5 through 12. The instruction, which
2 shall include matters relating to both the physical and legal
3 effects and ramifications of drug and substance abuse, shall be
4 integrated into existing curricula; and the State Board of
5 Education shall develop and make available to all elementary
6 and secondary schools in this State instructional materials and
7 guidelines which will assist the schools in incorporating the
8 instruction into their existing curricula. In addition, school
9 districts may offer, as part of existing curricula during the
10 school day or as part of an after school program, support
11 services and instruction for pupils or pupils whose parent,
12 parents, or guardians are chemically dependent.

14     Section 90. The State Mandates Act is amended by adding
15 Section 8.28 as follows:
 
16     (30 ILCS 805/8.28 new)
17     Sec. 8.28. Exempt mandate. Notwithstanding Sections 6 and 8
18 of this Act, no reimbursement by the State is required for the
19 implementation of any mandate created by this amendatory Act of
20 the 93rd General Assembly.
 
21     Section 99. Effective date. This Act takes effect upon
22 becoming law.".
