AMENDMENT TO SENATE BILL 2548

2     AMENDMENT NO. ______. Amend Senate Bill 2548 on page 2, by
3 replacing line 13 with the following:
4 "canceled during the past 10 years"; and
 
5 on page 3, by replacing line 23 with the following:
6 "not preempt or preclude additional appropriate civil or
7 criminal penalties."; and
 
8 on page 3, line 36, after "matters", by inserting "or provide
9 any other assistance that requires legal analysis, legal
10 judgment, or interpretation of the law"; and
 
11 on page 4, by replacing lines 16 and 17 with the following:
12     "(e) No notary public who is not an attorney or an
13 accredited representative shall accept payment in exchange for
14 providing legal advice or any other assistance that requires
15 legal analysis, legal judgment, or interpretation of the law.";
16 and
 
17 on page 5, by replacing lines 4 through 16 with the following:
18 "who is not an attorney or an accredited representative filling
19 out immigration legalization forms or applications related to
20 the Immigration Reform and Control Act of 1986 shall be limited
21 to the following as follows:
22     (1) $10 per form completion $75 per person;

1     (2) $10 per page for the translation of a non-English
2 language into English where such translation is required for
3 immigration forms $75 per person up to 4 persons per immediate
4 family, with no additional charge for a fifth or subsequent
5 person where all persons are legally related;
6     (3) $1 for notarizing $10 per page for the translation of a
7 non-English language into English where such translation is
8 required for legalization forms;
9     (4) $3 to execute any procedures necessary to obtain a
10 document required to complete immigration forms $1 for
11 notarizing; and
12     (5) A maximum of $75 for one complete application $3 to
13 execute any procedures necessary to obtain a document required
14 to complete legalization forms."; and
 
15 on page 5, by replacing lines 18 through 20 with the following:
16 "application fees required to be submitted with immigration
17 applications a legalization application in conformity with the
18 Immigration and Control Act of 1986."; and
 
19 on page 5, line 34, after "subsection", by inserting "within 90
20 days of receipt of a complaint,"; and
 
21 on page 6, by replacing lines 17 and 18 with the following:
22 "that arises under action of the United States Citizenship and
23 Immigration Services Immigration and Naturalization Service,
24 the United States Department of Labor,"; and
 
25 on page 6, by replacing lines 20 through 23 with the following:
26     ""Immigration assistance service" means any advice,
27 guidance, information, or action provided or offered to
28 customers or prospective customers related to immigration
29 matters, excluding legal advice, recommending a specific
30 course of legal action, or providing any other assistance that

1 requires legal analysis, legal judgment, or interpretation of
2 the law relating to any immigration matter."; and
 
3 on page 9, by replacing lines 7 through 11 with the following:
4     "Fees for a notary public, agency, or any other person who
5 is not an attorney or an accredited representative filling out
6 immigration forms shall be limited to the maximum fees set
7 forth in subsections (a) and (b) of Section 3-104 of the Notary
8 Public Act (5 ILCS 312/3-104) The Attorney General may
9 promulgate rules establishing maximum fees that may be charged
10 for the services described in this subsection. The maximum fees
11 must be reasonable in light of the costs of providing those
12 services and the degree of professional skill required to
13 provide the services."; and
 
14 on page 11, by replacing lines 2 through 4 with the following:
15     "Any person who provides or offers immigration assistance
16 service and is not exempted from this Section shall not, in any
17 document, advertisement, stationery, letterhead, business
18 card, or other comparable written material,"; and
 
19 on page 11, by replacing lines 16 through 21 with the
20 following:
21     "If not subject to penalties under subsection (a) of
22 Section 3-103 of the Notary Public Act (5 ILCS 312/3-103),
23 violations of this subsection shall result in a fine of $1,000.
24 Violations shall not preempt or preclude additional
25 appropriate civil or criminal penalties."; and
 
26 on page 11, line 30, after "services", by inserting "who is not
27 exempted under this Section"; and
 
28 on page 12, by replacing lines 1 and 2 with the following:
29     "(2.5) Accept payment in exchange for providing legal

1 advice or any other assistance that requires legal analysis,
2 legal judgment, or interpretation of the law."; and
 
3 on page 12, by replacing lines 20 through 23 with the
4 following:
5         "(5) Provide Give any legal advice, recommend a
6 specific course of legal action, or provide any other
7 assistance that requires legal analysis, legal judgment,
8 or interpretation of the law concerning an immigration
9 matter.".
