AMENDMENT TO SENATE BILL 2122

2     AMENDMENT NO. ______. Amend Senate Bill 2122 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Vehicle Code is amended by
5 changing Sections 3-405 and 3-415 as follows:
 
6     (625 ILCS 5/3-405)  (from Ch. 95 1/2, par. 3-405)
7     Sec. 3-405. Application for registration.
8     (a) Every owner of a vehicle subject to registration under
9 this Code shall make application to the Secretary of State for
10 the registration of such vehicle upon the appropriate form or
11 forms furnished by the Secretary. Every such application shall
12 bear the signature of the owner written with pen and ink and
13 contain:
14         1. The name, bona fide residence (except as otherwise
15 provided in this paragraph 1) and mail address of the owner
16 or business address of the owner if a firm, association or
17 corporation. If the mailing address is a post office box
18 number, the address listed on the driver license record may
19 be used to verify residence. A police officer, a deputy
20 sheriff, an elected sheriff, a law enforcement officer for
21 the Department of State Police, or a fire investigator may
22 elect to furnish the address of the headquarters of the
23 governmental entity or police district where he or she
24 works instead of his or her residence address, in which

1 case that address shall be deemed to be his or her
2 residence address for all purposes under this Chapter 3.
3 The spouse and children of a person who may elect under
4 this paragraph 1 to furnish the address of the headquarters
5 of the government entity or police district where the
6 person works instead of the person's residence address may,
7 if they reside with that person, also elect to furnish the
8 address of the headquarters of the government entity or
9 police district where the person works as their residence
10 address, in which case that address shall be deemed to be
11 their residence address for all purposes under this Chapter
12 3. In this paragraph 1: (A) "police officer" has the
13 meaning ascribed to "policeman" in Section 10-3-1 of the
14 Illinois Municipal Code; (B) "deputy sheriff" means a
15 deputy sheriff appointed under Section 3-6008 of the
16 Counties Code; (C) "elected sheriff" means a sheriff
17 commissioned pursuant to Section 3-6001 of the Counties
18 Code; and (D) "fire investigator" means a person classified
19 as a peace officer under the Peace Officer Fire
20 Investigation Act.
21         2. A description of the vehicle, including such
22 information as is required in an application for a
23 certificate of title, determined under such standard
24 rating as may be prescribed by the Secretary.
25         3. Information, as may be required by the Secretary,
26 relating to the insurance policy for the a motor vehicle,
27 including, but not limited to, the name of the insurer
28 which issued the policy, the policy number, and the
29 expiration date of the policy.
30         4. Such further information as may reasonably be
31 required by the Secretary to enable him to determine
32 whether the vehicle is lawfully entitled to registration
33 and the owner entitled to a certificate of title.
34         5. An affirmation by the applicant that all information

1 set forth is true and correct. If the application is for
2 the registration of a motor vehicle, the applicant also
3 shall affirm that the motor vehicle is insured as required
4 by this Code, that such insurance will be maintained
5 throughout the period for which the motor vehicle shall be
6 registered, and that neither the owner, nor any person
7 operating the motor vehicle with the owner's permission,
8 shall operate the motor vehicle unless the required
9 insurance is in effect. If the person signing the
10 affirmation is not the sole owner of the vehicle, such
11 person shall be deemed to have affirmed on behalf of all
12 the owners of the vehicle. If the person signing the
13 affirmation is not an owner of the vehicle, such person
14 shall be deemed to have affirmed on behalf of the owner or
15 owners of the vehicle. The lack of signature on the
16 application shall not in any manner exempt the owner or
17 owners from any provisions, requirements or penalties of
18 this Code.
19     (b) When such application refers to a new vehicle purchased
20 from a dealer the application shall be accompanied by a
21 Manufacturer's Statement of Origin from the dealer, and a
22 statement showing any lien retained by the dealer.

25     Sec. 3-415. Application for and renewal of registration.
26 (a) Calendar year. Application for renewal of a vehicle
27 registration shall be made by the owner, as to those vehicles
28 required to be registered on a calendar registration year, not
29 later than December 1 of each year, upon proper application and
30 by payment of the registration fee and tax for such vehicle, as
31 provided by law except that application for renewal of a
32 vehicle registration, as to those vehicles required to be
33 registered on a staggered calendar year basis, shall be made by

1 the owner in the form and manner prescribed by the Secretary of
2 State.
3     (b) Fiscal year. Application for renewal of a vehicle
4 registration shall be made by the owner, as to those vehicles
5 required to be registered on a fiscal registration year, not
6 later than June 1 of each year, upon proper application and by
7 payment of the registration fee and tax for such vehicle as
8 provided by law, except that application for renewal of a
9 vehicle registration, as to those vehicles required to be
10 registered on a staggered fiscal year basis, shall be made by
11 the owner in the form and manner prescribed by the Secretary of
12 State.
13     (c) Two calendar years. Application for renewal of a
14 vehicle registration shall be made by the owner, as to those
15 vehicles required to be registered for 2 calendar years, not
16 later than December 1 of the year preceding commencement of the
17 2-year registration period, except that application for
18 renewal of a vehicle registration, as to those vehicles
19 required to be registered for 2 years on a staggered
20 registration basis, shall be made by the owner in the form and
21 manner prescribed by the Secretary of State.
22     (d) Two fiscal years. Application for renewal of a vehicle
23 registration shall be made by the owner, as to those vehicles
24 required to be registered for 2 fiscal years, not later than
25 June 1 immediately preceding commencement of the 2-year
26 registration period, except that application for renewal of a
27 vehicle registration, as to those vehicles required to be
28 registered for 2 fiscal years on a staggered registration
29 basis, shall be made by the owner in the form and manner
30 prescribed by the Secretary of State.
31     (e) Time of application. The Secretary of State may receive
32 applications for renewal of registration and grant the same and
33 issue new registration cards and plates or registration
34 stickers at any time prior to expiration of registration. No

1 person shall display upon a vehicle, the new registration
2 plates or registration stickers prior to the dates the
3 Secretary of State in his discretion may select.
4     (f) Verification. The Secretary of State may further
5 require, as to vehicles for-hire, that applications be
6 accompanied by verification that fees due under the Illinois
7 Motor Carrier of Property Law, as amended, have been paid.
8     (g) Applications for registration renewal shall include
9 information relating to the insurance policy for the motor
10 vehicle, including the name of the insurer that issued the
11 policy, the policy number, and the expiration date of the
12 policy.

14     Section 99. Effective date. This Act takes effect January
15 1, 2005.".
