1     AN ACT concerning vehicles.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Sections 3-405 and 3-415 as follows:
 
6     (625 ILCS 5/3-405)  (from Ch. 95 1/2, par. 3-405)
7     Sec. 3-405. Application for registration.
8     (a) Every owner of a vehicle subject to registration under
9 this Code shall make application to the Secretary of State for
10 the registration of such vehicle upon the appropriate form or
11 forms furnished by the Secretary. Every such application shall
12 bear the signature of the owner written with pen and ink and
13 contain:
14         1. The name, bona fide residence (except as otherwise
15 provided in this paragraph 1) and mail address of the owner
16 or business address of the owner if a firm, association or
17 corporation. If the mailing address is a post office box
18 number, the address listed on the driver license record may
19 be used to verify residence. A police officer, a deputy
20 sheriff, an elected sheriff, a law enforcement officer for
21 the Department of State Police, or a fire investigator may
22 elect to furnish the address of the headquarters of the
23 governmental entity or police district where he or she
24 works instead of his or her residence address, in which
25 case that address shall be deemed to be his or her
26 residence address for all purposes under this Chapter 3.
27 The spouse and children of a person who may elect under
28 this paragraph 1 to furnish the address of the headquarters
29 of the government entity or police district where the
30 person works instead of the person's residence address may,
31 if they reside with that person, also elect to furnish the
32 address of the headquarters of the government entity or

1 police district where the person works as their residence
2 address, in which case that address shall be deemed to be
3 their residence address for all purposes under this Chapter
4 3. In this paragraph 1: (A) "police officer" has the
5 meaning ascribed to "policeman" in Section 10-3-1 of the
6 Illinois Municipal Code; (B) "deputy sheriff" means a
7 deputy sheriff appointed under Section 3-6008 of the
8 Counties Code; (C) "elected sheriff" means a sheriff
9 commissioned pursuant to Section 3-6001 of the Counties
10 Code; and (D) "fire investigator" means a person classified
11 as a peace officer under the Peace Officer Fire
12 Investigation Act.
13         2. A description of the vehicle, including such
14 information as is required in an application for a
15 certificate of title, determined under such standard
16 rating as may be prescribed by the Secretary.
17         3. Information, as may be required by the Secretary,
18 relating to the insurance policy for the a motor vehicle,
19 including, but not limited to, the name of the insurer
20 which issued the policy, the policy number, and the
21 expiration date of the policy.
22         4. Such further information as may reasonably be
23 required by the Secretary to enable him to determine
24 whether the vehicle is lawfully entitled to registration
25 and the owner entitled to a certificate of title.
26         5. An affirmation by the applicant that all information
27 set forth is true and correct. If the application is for
28 the registration of a motor vehicle, the applicant also
29 shall affirm that the motor vehicle is insured as required
30 by this Code, that such insurance will be maintained
31 throughout the period for which the motor vehicle shall be
32 registered, and that neither the owner, nor any person
33 operating the motor vehicle with the owner's permission,
34 shall operate the motor vehicle unless the required
35 insurance is in effect. If the person signing the
36 affirmation is not the sole owner of the vehicle, such

1 person shall be deemed to have affirmed on behalf of all
2 the owners of the vehicle. If the person signing the
3 affirmation is not an owner of the vehicle, such person
4 shall be deemed to have affirmed on behalf of the owner or
5 owners of the vehicle. The lack of signature on the
6 application shall not in any manner exempt the owner or
7 owners from any provisions, requirements or penalties of
8 this Code.
9     (b) When such application refers to a new vehicle purchased
10 from a dealer the application shall be accompanied by a
11 Manufacturer's Statement of Origin from the dealer, and a
12 statement showing any lien retained by the dealer.

15     Sec. 3-415. Application for and renewal of registration.
16 (a) Calendar year. Application for renewal of a vehicle
17 registration shall be made by the owner, as to those vehicles
18 required to be registered on a calendar registration year, not
19 later than December 1 of each year, upon proper application and
20 by payment of the registration fee and tax for such vehicle, as
21 provided by law except that application for renewal of a
22 vehicle registration, as to those vehicles required to be
23 registered on a staggered calendar year basis, shall be made by
24 the owner in the form and manner prescribed by the Secretary of
25 State.
26     (b) Fiscal year. Application for renewal of a vehicle
27 registration shall be made by the owner, as to those vehicles
28 required to be registered on a fiscal registration year, not
29 later than June 1 of each year, upon proper application and by
30 payment of the registration fee and tax for such vehicle as
31 provided by law, except that application for renewal of a
32 vehicle registration, as to those vehicles required to be
33 registered on a staggered fiscal year basis, shall be made by
34 the owner in the form and manner prescribed by the Secretary of
35 State.

1     (c) Two calendar years. Application for renewal of a
2 vehicle registration shall be made by the owner, as to those
3 vehicles required to be registered for 2 calendar years, not
4 later than December 1 of the year preceding commencement of the
5 2-year registration period, except that application for
6 renewal of a vehicle registration, as to those vehicles
7 required to be registered for 2 years on a staggered
8 registration basis, shall be made by the owner in the form and
9 manner prescribed by the Secretary of State.
10     (d) Two fiscal years. Application for renewal of a vehicle
11 registration shall be made by the owner, as to those vehicles
12 required to be registered for 2 fiscal years, not later than
13 June 1 immediately preceding commencement of the 2-year
14 registration period, except that application for renewal of a
15 vehicle registration, as to those vehicles required to be
16 registered for 2 fiscal years on a staggered registration
17 basis, shall be made by the owner in the form and manner
18 prescribed by the Secretary of State.
19     (e) Time of application. The Secretary of State may receive
20 applications for renewal of registration and grant the same and
21 issue new registration cards and plates or registration
22 stickers at any time prior to expiration of registration. No
23 person shall display upon a vehicle, the new registration
24 plates or registration stickers prior to the dates the
25 Secretary of State in his discretion may select.
26     (f) Verification. The Secretary of State may further
27 require, as to vehicles for-hire, that applications be
28 accompanied by verification that fees due under the Illinois
29 Motor Carrier of Property Law, as amended, have been paid.
30     (g) Applications for registration renewal shall include
31 information relating to the insurance policy for the motor
32 vehicle, including the name of the insurer that issued the
33 policy, the policy number, and the expiration date of the
34 policy.

1     Section 99. Effective date. This Act takes effect January
2 1, 2005.
