1     AN ACT concerning education.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The School Code is amended by adding Sections
5 10-20.39 and 34-18.30 as follows:
 
6     (105 ILCS 5/10-20.39 new)
7     Sec. 10-20.39. Highly qualified teachers; No Child Left
8 Behind Act funds. If a school district has an overall shortage
9 of highly qualified teachers, as defined by the federal No
10 Child Left Behind Act of 2001 (Public Law 107-110), or a
11 shortage of highly qualified teachers in the subject area of
12 mathematics, science, reading, or special education, then the
13 school board must spend at least 40% of the money it receives
14 from Title 2 grants under the Act on professional development
15 for teachers (in a specific subject area if applicable) until
16 there is no longer a shortage of highly qualified teachers (in
17 a specific subject area if applicable). As the number of highly
18 qualified teachers in the district increases, however, the
19 school board may spend any surplus of the minimum 40% of funds
20 dedicated to addressing the highly qualified teacher shortage
21 in any manner the school board deems appropriate.

8 becoming law.
