SYNOPSIS AS INTRODUCED:
 
725 ILCS 5/110-13   from Ch. 38, par. 110-13

    Amends the Code of Criminal Procedure of 1963. Prohibits a victim of domestic violence from furnishing any part of any security for bail in a criminal case or proceeding for any alleged repeat offender alleged to have caused the abuse against the victim and from acting as surety for the alleged repeat offender admitted to bail. Provides that the provision is applicable even if an order of protection has not been issued against the alleged repeat offender.

1     AN ACT in relation to criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Code of Criminal Procedure of 1963 is
5 amended by changing Section 110-13 as follows:
 
6     (725 ILCS 5/110-13)  (from Ch. 38, par. 110-13)
7     Sec. 110-13. Persons prohibited from furnishing bail
8 security.
9     (a) No attorney at law practicing in this State and no
10 official authorized to admit another to bail or to accept bail
11 shall furnish any part of any security for bail in any criminal
12 action or any proceeding nor shall any such person act as
13 surety for any accused admitted to bail.
14     (b) A victim of domestic violence as defined in Section
15 112A-3 of this Code may not furnish any part of any security
16 for bail in any criminal action or any proceeding for any
17 alleged repeat offender alleged to have caused the abuse
18 against the victim and may not act as surety for the alleged
19 repeat offender admitted to bail. This subsection (b) is
20 applicable even if an order of protection has not been issued
21 against the alleged repeat offender.
