1     AN ACT concerning motor vehicles.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Motor Vehicle Franchise Act is amended by
5 changing Section 16 as follows:
 
6     (815 ILCS 710/16)
7     Sec. 16. Motor Vehicle Review Board; Appointment. The
8 Secretary of State shall, within 6 months of the effective date
9 of this Act, establish a Motor Vehicle Review Board. The Motor
10 Vehicle Review Board ("the Board") shall be composed of 7
11 members appointed by the Secretary of State. The members shall
12 represent the public interest at large and shall not have
13 engaged in the sale, manufacture, or distribution of motor
14 vehicles at retail in this State. Each member of the Board
15 shall receive compensation as provided in the regulations for
16 performance of the duties of the office, and in addition, shall
17 be paid all travel and other necessary expenses incurred while
18 performing official duties. Terms of office of the members
19 shall be for 3 years, except that, of the members first
20 appointed to take office after the effective date of this
21 amendatory Act of 1995, 2 shall be appointed for a 3-year term,
22 and one shall be appointed for a 2-year term. Of the members
23 first appointed under this amendatory Act of 1996, one shall be
24 appointed to a 3-year term, and one shall be appointed to a
25 2-year term. Of the members first appointed to take office
26 after the effective date of this amendatory Act of the 91st
27 General Assembly, one shall be appointed to a 3-year term and
28 one shall be appointed to a 2-year term. Thereafter, each
29 member shall be appointed for a 3-year term. As terms of
30 appointment expire, members shall serve until their respective
31 successors are appointed and qualified. No more than 4 members
32 of the Board may be of the same political party. A member who

1 tenders a written resignation shall serve only until the
2 resignation is accepted by the Chairperson. A member who fails
3 to attend 3 consecutive Board meetings without an excused
4 absence shall no longer serve as a member. The Secretary of
5 State shall fill any vacancy by the appointment of a member for
6 the unexpired term of the member in the same manner as in the
7 making of original appointments. Annually, the Board shall
8 organize by selecting a Chairperson from one of the 7 members
9 from the public at large.
