1     AN ACT in relation to agriculture.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Livestock Management Facilities Act is
5 amended by changing Section 10.30 as follows:
 
6     (510 ILCS 77/10.30)
7     Sec. 10.30. Livestock management facility. "Livestock
8 management facility" means any animal feeding operation,
9 livestock shelter, or on-farm milking and accompanying
10 milk-handling area. Two or more livestock management
11 facilities under common ownership, where the facilities are not
12 separated by a minimum distance of 1/4 mile, and that share a
13 common livestock waste handling facility shall be considered a
14 single livestock management facility. A Livestock management
15 facilities facility at educational institutions, livestock
16 pasture operations, where animals are housed on a temporary
17 basis such as county and state fairs, livestock shows, race
18 tracks, and horse breeding and foaling farms, and market
19 holding facilities are not subject to this Act.
