| AN ACT concerning mental health and developmental |

| disabilities.

| 3 |
| Be it enacted by the People of the State of Illinois, |
| 4 |
| represented in the General Assembly:
|
| 5 |
| Section 5. The Mental Health and Developmental |
| 6 |
| Disabilities Code is amended
by changing Section 2-101 as |
| 7 |
| follows:
|
| 8 |
| (405 ILCS 5/2-101) (from Ch. 91 1/2, par. 2-101)

| Sec. 2-101. No recipient of services shall be presumed |
| 10 |
| legally disabled,
nor shall such person be held legally |
| 11 |
| disabled except as determined by a
court. A
Such determination |
| 12 |
| of legal disability shall be separate
from a judicial |
| 13 |
| proceeding held to determine whether a person is subject to
|
| 14 |
| involuntary admission or meets the standard for judicial |
| 15 |
| admission.
