AMENDMENT TO HOUSE BILL 5164

2     AMENDMENT NO. ______. Amend House Bill 5164 on page 4, line
3 26, before "judgment", by inserting "reasonable"; and
 
4 on page 4, line 27, by replacing "public's health" with "public
5 from a dangerously contagious or infectious disease"; and
 
6 on page 4, line 33, by replacing "make it untenable" with
7 "cause the court system to be unavailable or that make it
8 impossible"; and
 
9 on page 5, by replacing lines 12 through 14 with the following:
10 "purposes of this subsection, in determining whether no less
11 restrictive alternative exists, the court shall consider
12 evidence showing that, under the circumstances"; and
 
13 on page 5, line 22, by deleting ", and shall be notified of
14 that right"; and
 
15 on page 5, line 24, after the period, by inserting the
16 following:
17 "Persons who are ordered to be isolated or quarantined or who
18 are owners of places that are ordered to be closed and made off
19 limits to the public, shall be given a written notice of such
20 order. The written notice shall additionally include the
21 following: (1) notice of the right to counsel; (2) notice that

1 if the person or owner is indigent, the court will appoint
2 counsel for that person or owner; (3) notice of the reason for
3 the order for isolation, quarantine or closure; (4) notice of
4 whether the order is an immediate order, and if so, the time
5 frame for the Department to seek consent or to file a petition
6 requesting a court order as set out in this subsection; and (5)
7 notice of the anticipated duration of the isolation,
8 quarantine, or closure."; and
 
9 on page 6, line 5, by replacing "informed" with "given a
10 written notice that shall include notice"; and
 
11 on page 6, line 25, after the period, by inserting the
12 following:
13 "To the extent feasible without endangering the public's
14 health, the Department shall respect and accommodate the
15 religious beliefs of individuals in implementing this
16 subsection."; and
 
17 on page 7, line 3, by replacing "informed" with "given a
18 written notice that shall include notice"; and
 
19 on page 7, line 13, after the period, by inserting the
20 following:
21 "To the extent feasible without endangering the public's
22 health, the Department shall respect and accommodate the
23 religious beliefs of individuals in implementing this
24 subsection."; and
 
25 on page 7, line 25, by replacing "informed" with "given written
26 notice that shall include notice"; and
 
27 on page 8, line 9, after the period, by inserting the

1 "An owner of such animal or other property shall be given
2 written notice regarding such examination, testing,
3 disinfection, seizure, or destruction."; and
 
4 on page 8, line 10, after "animal", by inserting "or property";
5 and
 
6 on page 8, line 35, after the period, by inserting the
7 following:
8 "All final administrative decisions of the Department
9 hereunder shall be subject to judicial review pursuant to the
10 provisions of the Administrative Review Law, and all amendments
11 and modifications thereof, and the rules adopted pursuant
12 thereto. The term "administrative decision" is defined as in
13 Section 3-101 of the Code of Civil Procedure."; and
 
14 on page 10, line 14, after "any", by inserting "syndromic"; and
 
15 on page 10, line 25, after "purposes", by inserting the
16 following:
17 "by the Department, local public health authorities, or the
18 Centers for Disease Control and Prevention"; and
 
19 on page 12, line 14, by deleting ", related"; and
 
20 on page 12, line 15, by deleting "to,"; and
 
21 on page 12, lines 23 and 24, by deleting ", related to,"; and
 
22 on page 13, line 9, after the period, by inserting the
23 following:
24 "To the extent feasible without endangering the public's

4 appears with "preparedness and response"; and
 
5 on page 15, by replacing lines 1 and 2 with the following:
6 "organizations on public health preparedness and response.";
7 and
 
8 on page 17, line 22, by replacing "civilly liable" with "liable
9 for civil damages".
