SYNOPSIS AS INTRODUCED:
 
210 ILCS 85/6.16a new

    Amends the Hospital Licensing Act. Provides that as a condition of licensure, a hospital must develop a written pamphlet that highlights the hospital's organ donation policy and procedures and must provide the pamphlet to potential organ donors or their families. Requires the Department of Public Health to conduct a study of hospitals in Illinois to determine which hospitals provide for organ donations from asystolic donors. Effective immediately.

1     AN ACT concerning hospitals.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Hospital Licensing Act is amended by adding
5 Section 6.16a as follows:
 
6     (210 ILCS 85/6.16a new)
7     Sec. 6.16a. Organ donation policy and procedures; study.
8     (a) As a condition of licensure under this Act, each
9 hospital in Illinois must develop a written pamphlet or
10 brochure that highlights the hospital's organ donation policy
11 and procedures. In addition to other relevant information, the
12 pamphlet or brochure must include information specifying how an
13 individual, or an individual's family in the case of
14 incapacitation, may donate organs. The pamphlet or brochure
15 must also include a description of the hospital's policy in
16 relation to asystolic donors, or those that have not been
17 declared brain dead prior to the point that the donor's heart
18 stops beating. The hospital must provide the pamphlet or
19 brochure to a potential donor or the donor's family upon the
20 first statement by the potential donor or family that they are
21 interested in donating organs.
22     (b) Based on information contained in the pamphlets or
23 brochures prepared by hospitals under subsection (a), or by any
24 other appropriate means available, the Department of Public
25 Health shall conduct a study of hospitals in Illinois to
26 determine which hospitals provide for organ donations from
27 asystolic donors. The Department shall report its findings to
28 the General Assembly no later than January 1, 2005.
 
29     Section 99. Effective date. This Act takes effect upon
30 becoming law.
