AMENDMENT TO HOUSE BILL 4283

2     AMENDMENT NO. ______. Amend House Bill 4283 on page 1, line
3 14, by replacing every thing after the enacting clause with the
4 following:
 
5     "Section 5. The Raffles Act is amended by adding Section
6 8.2 as follows:
 
7     (230 ILCS 15/8.2 new)
8     Sec. 8.2. Exemption for children's research hospital.
9     (a) A charitable institution is not subject to the
10 licensing provisions of subsection (a) of Section 2, items (1),
11 (2), (3), (4), and (5) of Section 3, and the restrictions on
12 the conduct of raffles imposed under item (5) of Section 4 if
13 (i) the sole purpose of the charitable institution is to raise
14 funds for a children's research hospital that is exempted from
15 the payment of federal income taxes by the United States
16 Internal Revenue Code (26 U.S.C. Section 501(c)(3)), (ii) the
17 net proceeds from raffles conducted by the charitable
18 institution under this Act are used by the organization for
19 charitable, scientific, or educational purposes, and (iii) the
20 charitable institution obtains a license from the Department
21 under subsection (b).
22     (b) The Department of Revenue shall, upon application
23 therefor on forms prescribed by that Department, and upon the
24 payment of an annual fee of $200, and upon a determination by

1 the Department that the applicant is a charitable institution
2 that meets the qualifications in items (i) and (ii) of
3 subsection (a), issue a license authorizing the charitable
4 institution to conduct raffles. A license issued under this
5 subsection (b) shall be valid for one year.
6     (c) For a charitable organization that conducts raffles
7 under this Section, all references in Sections 5 and 6 of this
8 Act to a licensing authority mean the Illinois Department of
9 Revenue.
 
10     Section 99. Effective date. This Act takes effect upon
11 becoming law.".
