 1        AN ACT concerning public contracts.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 1.  Short title. This Act may  be  cited  as  the
 5    Public Works Contract Change Order Act.

 6        Section  5.  Change  orders;  bidding.  If a change order
 7    for any public works contract (i)  is  entered  into  by  the
 8    State  or  by a unit of local government or a school district
 9    that receives State funds for construction under the Illinois
10    Procurement Code or the State Finance Act and (ii) authorizes
11    or necessitates any increase in the contract  price  that  is
12    25%  or  more  of the original contract price, the portion of
13    the contract that is covered by  the  change  order  must  be
14    resubmitted  for  bidding  in  the  same manner for which the
15    original contract was bid. Bidding for  the  portion  of  the
16    contract  covered  by  the  change  order  is  subject to any
17    requirements to employ females and minorities on  the  public
18    works  project  that  existed at the bidding for the original
19    contract, together with any  later  requirements  imposed  by
20    law. The provisions of this Act do not apply to change orders
21    that  are  the  result  of  an  emergency as determined under
22    Section 16 of the Capital Development Board Act.

23        Section 10.  Mandates.   This  Act  is  exempt  from  the
24    reimbursement requirements of the State Mandates Act.

25        Section  90.  The State Mandates Act is amended by adding
26    Section 8.27 as follows:

28        Sec. 8.27. Exempt mandate.   Notwithstanding  Sections  6

 1    and  8 of this Act, no reimbursement by the State is required
 2    for the implementation of any mandate created by  the  Public
 3    Works Contract Change Order Act.
