 1        AN ACT concerning public contracts.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 1.  Short title. This Act may  be  cited  as  the
 5    Public Works Contract Change Order Act.

 6        Section  5.  Change  orders;  bidding.  If a change order
 7    for any public works contract entered into by  the  State,  a
 8    unit  of local government, or a school district authorizes or
 9    necessitates any increase in the contract price that  is  25%
10    or  more  of  the original contract price, the portion of the
11    contract  that  is  covered  by  the  change  order  must  be
12    resubmitted for bidding in the  same  manner  for  which  the
13    original  contract  was  bid.  Bidding for the portion of the
14    contract covered by  the  change  order  is  subject  to  any
15    requirements  to  employ females and minorities on the public
16    works project that existed at the bidding  for  the  original
17    contract,  together  with  any  later requirements imposed by
18    law.

19        Section  10.  Home  rule.   A  home  rule  unit  may  not
20    regulate  its  public  works  contracts  in  manner  that  is
21    inconsistent with this Act.  This Section is a limitation  of
22    home rule powers under subsection (i) of Section 6 of Article
23    VII of the Illinois Constitution.

24        Section  15.   Mandates.   This  Act  is  exempt from the
25    reimbursement requirements of the State Mandates Act.

26        Section 90.  The State Mandates Act is amended by  adding
27    Section 8.27 as follows:

 2        Sec.  8.27.  Exempt  mandate.  Notwithstanding Sections 6
 3    and 8 of this Act, no reimbursement by the State is  required
 4    for  the  implementation of any mandate created by the Public
 5    Works Contract Change Order Act.
