 1                    AMENDMENT TO HOUSE BILL 1866

 2        AMENDMENT NO.     .  Amend House Bill 1866  by  replacing
 3    the title with the following:
 4        "AN ACT in relation to crime stoppers programs."; and

 5    by  replacing  everything  after the enacting clause with the
 6    following:

 7        "Section 1. Short title. This Act may  be  cited  as  the
 8    Crime Stoppers Program Act.

 9        Section  5.  Definition.  In  this  Act,  "Crime Stoppers
10    program" means a program that meets  each  of  the  following
11    requirements:
12        (1)  The  purpose of the program is to obtain information
13    on persons  wanted  for  crimes,  felony  crimes,  and  other
14    criminal activity.
15        (2)  The  program  has  a law enforcement coordinator who
16    forwards  information  obtained  by  the   program   to   the
17    appropriate law enforcement agency.
18        (3)  The program allows the person submitting information
19    to remain anonymous.
20        (4)  The  program  operates  in  conjunction  with  a law
21    enforcement agency or Office of the State's Attorney.

 1        (5)  The program has a civilian board  of  directors,  is
 2    incorporated  in  the  State of Illinois, and is certified by
 3    the Illinois State Crime Stoppers Association.

 4        Section  10.  Certification  of  programs.  The  Illinois
 5    State Crime Stoppers Association shall certify Crime Stoppers
 6    programs in this State.  On or after the  effective  date  of
 7    this  Act,  a  person or agency that is not a certified Crime
 8    Stoppers program may not use the name "Crime Stoppers".   The
 9    Attorney  General may enforce this Section through injunctive
10    or other appropriate relief.

11        Section 105. The Code of Civil Procedure  is  amended  by
12    adding Section 8-802.3 as follows:

13        (735 ILCS 5/8-802.3 new)
14        Sec. 8-802.3.  Identity of person who submits information
15    to  a  Crime  Stoppers program; privileged. The identity of a
16    person who submits information of a criminal act to  a  Crime
17    Stoppers  program  is  privileged  information and may not be
18    disclosed  in  any  judicial  or  administrative  proceeding.
19    Telephone records of a Crime Stoppers program are  privileged
20    information  and are not subject to disclosure by subpoena or
21    other means. In this Section, "Crime Stoppers program"  means
22    a  program  certified  by  the  Illinois State Crime Stoppers
23    Association under the Crime Stoppers Program Act.".
