 1        AN ACT concerning State holidays.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The State Commemorative Dates Act is amended
 5    by adding Section 115 as follows:

 6        (5 ILCS 490/115 new)
 7        Sec. 115.  Cesar Chavez Day.  March 31 of each year is  a
 8    legal holiday to be known as Cesar Chavez Day.  When March 31
 9    falls  on a Saturday or Sunday, the following Monday shall be
10    held and considered the holiday.  No officer or  employee  of
11    the State may be required to work on Cesar Chavez Day, except
12    those  persons  necessary  for (i) law enforcement, (ii) fire
13    protection, and (iii) public health and safety.   The  courts
14    of  this  State  shall  designate Cesar Chavez Day as a court
15    holiday.

16        Section 10.  The Civil Administrative Code of Illinois is
17    amended by changing Section 5-635 as follows:

19        Sec. 5-635.  Department  office  hours.  Each  department
20    shall be open for the transaction of public business at least
21    from  8:30  in  the morning until 5:00 in the evening of each
22    day except Saturdays, Sundays, Cesar Chavez Day  as  provided
23    in  the  State  Commemorative  Dates  Act,  and days that may
24    hereafter be declared by the  Governor  to  be  holidays  for
25    State employees.

27        Section  15.   The Office of Banks and Real Estate Act is
28    amended by changing Section 3 as follows:

 2        Sec. 3.  Business hours.  The Office of  Banks  and  Real
 3    Estate  shall be open for transaction of public business from
 4    8:30 a.m. to 5:00 p.m. or at such other hours as the Governor
 5    may prescribe from time to time by executive order,  on  each
 6    day  except  Saturdays, Sundays, Cesar Chavez Day as provided
 7    in the State Commemorative Dates Act, and  days  declared  by
 8    the Governor to be holidays for State employees.

10        Section  20.   The  School  Code  is  amended by changing
11    Section 24-2 as follows:

12        (105 ILCS 5/24-2) (from Ch. 122, par. 24-2)
13        Sec. 24-2.  Holidays.  Teachers shall not be required  to
14    teach  on  Saturdays;  nor  shall  teachers  or  other school
15    employees, other than noncertificated school employees  whose
16    presence  is  necessary  because  of  an emergency or for the
17    continued operation and maintenance of school  facilities  or
18    property, be required to work on legal school holidays, which
19    are  January  1, New Year's Day; the third Monday in January,
20    the Birthday of Dr. Martin Luther King, Jr.; February 12, the
21    Birthday of President Abraham Lincoln; the  first  Monday  in
22    March  (to  be  known  as  Casimir  Pulaski's birthday); Good
23    Friday; the day designated as Memorial Day  by  federal  law;
24    July  4,  Independence  Day;  the  first Monday in September,
25    Labor Day;  the  second  Monday  in  October,  Columbus  Day;
26    November 11, Veteran's Day; the Thursday in November commonly
27    called  Thanksgiving  Day;  and  December  25, Christmas Day.
28    School boards may grant special holidays  whenever  in  their
29    judgment  such  action  is  advisable,  except that no school
30    board or board of education may designate  or  observe  as  a
31    special  holiday  on which teachers or other school employees
32    are not required to work the days on which general  elections

 1    for  members  of  the  Illinois  House of Representatives are
 2    held.  No  deduction  shall  be  made  from   the   time   or
 3    compensation  of a school employee on account of any legal or
 4    special holiday.
 5        Commemorative   holidays,   which   recognize   specified
 6    patriotic, civic, cultural or historical persons, activities,
 7    or events, are regular school  days.  Commemorative  holidays
 8    are:  January  28  (to  be known as Christa McAuliffe Day and
 9    observed as a commemoration of space  exploration),  February
10    15 (the birthday of Susan B. Anthony), March 29 (Viet Nam War
11    Veterans   Day),   September   11   (September  11th  Day  of
12    Remembrance), the school day immediately preceding  Veteran's
13    Day  (Korean  War  Veterans  Day), October 1 (Recycling Day),
14    December 7  (Pearl  Harbor  Veterans  Day)  and  any  day  so
15    appointed  by  the  President or Governor.  School boards may
16    establish commemorative holidays whenever in  their  judgment
17    such  action  is advisable. March 31 (Cesar Chavez Day) shall
18    be a special commemorative holiday  that  school  boards  are
19    permitted  to  designate  as  a  legal school holiday. School
20    boards shall include  instruction  relative  to  commemorated
21    persons,  activities,  or events on the commemorative holiday
22    or at any other time during the school year and at any  point
23    in  the  curriculum  when  such  instruction  may  be  deemed
24    appropriate.  The  State Board of Education shall prepare and
25    make  available  to  school  boards  instructional  materials
26    relative to commemorated persons, activities, or events which
27    may  be  used  by  school  boards  in  conjunction  with  any
28    instruction provided  pursuant  to  this  paragraph.    These
29    materials  shall  include a model curriculum guide sufficient
30    for  at  least  one  hour  of   instruction   and   exercises
31    commemorating  the  history of the farm labor movement in the
32    United States with particular attention to the role of  Cesar
33    Chavez in that movement.
34        City of Chicago School District 299 shall observe March 4

 1    of  each year as a commemorative holiday.  This holiday shall
 2    be known as Mayors' Day which shall be a day  to  commemorate
 3    and  be  reminded of the past Chief Executive Officers of the
 4    City of Chicago, and in particular the late Mayor Richard  J.
 5    Daley and the late Mayor Harold Washington.  If March 4 falls
 6    on a Saturday or Sunday, Mayors' Day shall be observed on the
 7    following Monday.

 9        Section  25.  The State Universities Civil Service Act is
10    amended by changing Section 45a as follows:

11        (110 ILCS 70/45a) (from Ch. 24 1/2, par. 38l.1)
12        Sec. 45a.  Except as provided in the second  sentence  of
13    this  Section,  all   officers  and employees subject to this
14    Act, shall have the following days  as  holidays,  for  which
15    they shall receive their usual compensation:  New Year's Day,
16    January  1,  Cesar  Chavez  Day  as  provided  in  the  State
17    Commemorative  Dates  Act, Memorial Day, as determined by the
18    law of the State of Illinois, Independence Day, July 4, Labor
19    Day, the first Monday in  September,  Thanksgiving  Day,  the
20    fourth  Thursday of November, Christmas Day, December 25, and
21    five holidays to be designated by each  college,  university,
22    agency  and community college subject to this Act.  Craft and
23    trade employees subject to this Act shall  be  paid  for  all
24    paid  holidays  included in their area agreement, and will be
25    paid for all  five  holidays  designated  by  their  employer
26    pursuant to this section.

28        Section  90.  The State Mandates Act is amended by adding
29    Section 8.27 as follows:

 1        Sec. 8.27. Exempt mandate.   Notwithstanding  Sections  6
 2    and  8 of this Act, no reimbursement by the State is required
 3    for  the  implementation  of  any  mandate  created  by  this
 4    amendatory Act of the 93rd General Assembly.

 5        Section 99.  Effective date.  This Act takes effect  upon
 6    becoming law.
