 1                     AMENDMENT TO HOUSE BILL 920

 2        AMENDMENT NO.     .  Amend House Bill  920  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.  The Northeastern Illinois University Law is
 5    amended by changing Section 25-15 as follows:

 6        (110 ILCS 680/25-15)
 7        Sec. 25-15.  Membership;  terms;  vacancies.   The  Board
 8    shall  consist  of 9 voting members who are residents of this
 9    State and are appointed by the  Governor,  by  and  with  the
10    advice  and  consent of the Senate, and one voting member who
11    is  a  student  at  Northeastern  Illinois  University.   The
12    student member shall be elected by a campus-wide election  of
13    all  students  of  the  University.  The student member shall
14    serve a term of one year beginning on July 1  of  each  year,
15    except  that the student member initially selected under this
16    amendatory Act of the 91st General  Assembly  shall  serve  a
17    term  beginning  on  the  date  of  his  or her selection and
18    expiring on the next succeeding June 30.   A  student  member
19    may  serve  only for one term.  To be eligible to remain as a
20    student member of the Board, the student  member  must  be  a
21    resident  of this State, must have and maintain a grade point
22    average that is equivalent to at least 2.5 on  a  4.0  scale,

 1    and must be a full time undergraduate student enrolled at all
 2    times  during  his or her term of office except for that part
 3    of the term which follows the completion  of  the  last  full
 4    regular  semester  of an academic year and precedes the first
 5    full regular semester of the succeeding academic year at  the
 6    university  (sometimes  commonly  referred  to  as the summer
 7    session or summer school).  If a student  member  serving  on
 8    the   Board  fails  to  continue  to  meet  or  maintain  the
 9    residency,  minimum  grade  point  average,   or   enrollment
10    requirement   established   by   this  Section,  his  or  her
11    membership on the Board shall be deemed to have terminated by
12    operation of law.  If any member of the  Board  appointed  by
13    the  Governor  fails  to  continue  to  meet  or maintain the
14    residency requirement established by this Section, he or  she
15    shall   resign   membership  on  the  Board  within  30  days
16    thereafter and, failing submission of this  resignation,  his
17    or  her  membership  on  the  Board  shall  be deemed to have
18    terminated  by  operation  of  law.   Of  the  members  first
19    appointed by the Governor, 4 shall be appointed for terms  to
20    expire  on  the third Monday in January, 1999 and until their
21    successors are  appointed  and  qualified,  and  3  shall  be
22    appointed for terms to expire on the third Monday in January,
23    2001  and until their successors are appointed and qualified.
24    The 2 additional members appointed by the  Governor,  by  and
25    with  the  advice  and  consent  of  the  Senate,  under this
26    amendatory Act of the 91st General  Assembly,  shall  not  be
27    from  the  same  political  party  and shall be appointed for
28    terms to expire on the third  Monday  in  January,  2003  and
29    until  their  successors  are  appointed  and qualified.  Any
30    vacancy in membership existing on January 1,  1999  shall  be
31    filled  by  appointment  by the Governor, with the advice and
32    consent of the Senate, for a term  to  expire  on  the  third
33    Monday  in January, 2003.  If the Senate is not in session on
34    the effective date of this Article, or if  a  vacancy  in  an

 1    appointive membership occurs at a time when the Senate is not
 2    in session, the Governor shall make temporary appointments to
 3    fill  the vacancy.  Members with these temporary appointments
 4    shall be deemed qualified to serve upon appointment and shall
 5    continue to serve until the next meeting of the  Senate  when
 6    the  Governor shall appoint persons to fill such memberships,
 7    by and with the advice and consent of  the  Senate,  for  the
 8    remainder  of  their respective terms.  No more than 5 of the
 9    members appointed by the Governor shall  be  affiliated  with
10    the  same  political  party.   Each  member  appointed by the
11    Governor must be a resident of this State.  A failure to meet
12    or  maintain  this  residency   requirement   constitutes   a
13    resignation  from  and  creates a vacancy in the Board.  Upon
14    the expiration of the  terms  of  members  appointed  by  the
15    Governor   for   other  than  temporary  appointments,  their
16    respective successors shall be appointed,  by  and  with  the
17    advice  and  consent of the Senate, for terms of 6 years from
18    the third Monday in January of each odd-numbered year.    Any
19    members  appointed  to  the  Board shall continue to serve in
20    such  capacity  until  their  successors  are  appointed  and
21    qualified.

24        Section  99.  Effective date.  This Act takes effect upon
25    becoming law.".
