AMENDMENT TO HOUSE BILL 758

2     AMENDMENT NO. ______. Amend House Bill 758 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The School Code is amended by changing Section
5 11D-6 as follows:
 
6     (105 ILCS 5/11D-6)  (from Ch. 122, par. 11D-6)
7     Sec. 11D-6. Passage requirements. If a majority of the
8 electors voting at such election in each affected school
9 district vote in favor of the proposition, the proposition
10 shall be deemed to have passed. Unless the board of education
11 of a new high school or elementary school district is elected
12 at the same election at which the proposition establishing that
13 district is deemed to have passed, the regional superintendent
14 of schools shall order an election to be held on the next
15 regularly scheduled election date for the purpose of electing a
16 board of education for that district. In either event, the
17 board of education elected for each of the new high school and
18 elementary school districts created under this Article shall
19 consist of 7 members, which shall have the terms and the powers
20 and duties of school boards as defined in Article 10. Election
21 of board members for the new high school district may be (i) on
22 an at-large basis, (ii) with board members representing each of
23 the forming elementary school districts, or (iii) a combination
24 of both. The format for the election of the new high school

1 board must be defined in the petition submitted to the voters.
2 When 4 or more unit school districts are involved and a
3 combination of board members representing each of the forming
4 elementary school districts and at-large formats are used, one
5 member must be elected from each of the forming elementary
6 school districts. The remaining members may be elected on an
7 at-large basis, provided that none of the underlying elementary
8 school districts have a majority on the resulting high school
9 board. When 3 unit school districts are involved and a
10 combination of board members representing each of the forming
11 elementary school districts and at-large formats are used, 2
12 members must be elected from each of the forming elementary
13 school districts. The remaining member must be elected at
14 large. Nomination papers filed under this Section are not valid
15 unless the candidate named therein files with the regional
16 superintendent a receipt from the county clerk showing that the
17 candidate has filed a statement of economic interests as
18 required by the Illinois Governmental Ethics Act. Such receipt
19 shall be so filed either previously during the calendar year in
20 which his nomination papers were filed or within the period for
21 the filing of nomination papers in accordance with the general
22 election law. The regional superintendent shall perform the
23 election duties assigned by law to the secretary of a school
24 board for such election, and shall certify the officers and
25 candidates therefor pursuant to the general election law.

27     Section 99. Effective date. This Act takes effect upon
28 becoming law.".
