1 AMENDMENT TO HOUSE BILL 714
2 AMENDMENT NO. . Amend House Bill 714 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The State Finance Act is amended by changing
5 Section 6z-48 as follows:
6 (30 ILCS 105/6z-48)
7 Sec. 6z-48. Motor Vehicle License Plate Fund.
8 (a) The Motor Vehicle License Plate Fund is hereby
9 created as a special fund in the State Treasury. The Fund
10 shall consist of the deposits provided for in Section 2-119
11 of the Illinois Vehicle Code and any moneys appropriated to
12 the Fund.
13 (b) The Motor Vehicle License Plate Fund shall be used,
14 subject to appropriation, for the costs incident to providing
15 new or replacement license plates for motor vehicles.
16 (c) Any balance remaining in the Motor Vehicle License
17 Plate Fund at the close of business on December 31, 2004
18 shall be transferred into the Road Fund, and the Motor
19 Vehicle License Plate Fund is abolished when that transfer
20 has been made.

1 Section 10. The Illinois Vehicle Code is amended by
2 changing Section 2-119 as follows:
3 (625 ILCS 5/2-119) (from Ch. 95 1/2, par. 2-119)
4 Sec. 2-119. Disposition of fees and taxes.
5 (a) All moneys received from Salvage Certificates shall
6 be deposited in the Common School Fund in the State Treasury.
7 (b) Beginning January 1, 1990 and concluding December
8 31, 1994, of the money collected for each certificate of
9 title, duplicate certificate of title and corrected
10 certificate of title, $0.50 shall be deposited into the Used
11 Tire Management Fund. Beginning January 1, 1990 and
12 concluding December 31, 1994, of the money collected for each
13 certificate of title, duplicate certificate of title and
14 corrected certificate of title, $1.50 shall be deposited in
15 the Park and Conservation Fund.
16 Beginning January 1, 1995, of the money collected for
17 each certificate of title, duplicate certificate of title and
18 corrected certificate of title, $2 shall be deposited in the
19 Park and Conservation Fund. The moneys deposited in the Park
20 and Conservation Fund pursuant to this Section shall be used
21 for the acquisition and development of bike paths as provided
22 for in Section 805-420 of the Department of Natural Resources
23 (Conservation) Law (20 ILCS 805/805-420).
24 Beginning January 1, 2000 and continuing through December
25 31, 2004, of the moneys collected for each certificate of
26 title, duplicate certificate of title, and corrected
27 certificate of title, $48 shall be deposited into the Road
28 Fund and $4 shall be deposited into the Motor Vehicle License
29 Plate Fund, except that if the balance in the Motor Vehicle
30 License Plate Fund exceeds $40,000,000 on the last day of a
31 calendar month, then during the next calendar month the $4
32 shall instead be deposited into the Road Fund.
33 Beginning January 1, 2005, of the moneys collected for

1 each certificate of title, duplicate certificate of title,
2 and corrected certificate of title, $52 shall be deposited
3 into the Road Fund.
4 Except as otherwise provided in this Code, all remaining
5 moneys collected for certificates of title, and all moneys
6 collected for filing of security interests, shall be placed
7 in the General Revenue Fund in the State Treasury.
8 (c) All moneys collected for that portion of a driver's
9 license fee designated for driver education under Section
10 6-118 shall be placed in the Driver Education Fund in the
11 State Treasury.
12 (d) Beginning January 1, 1999, of the monies collected
13 as a registration fee for each motorcycle, motor driven cycle
14 and motorized pedalcycle, 27% of each annual registration fee
15 for such vehicle and 27% of each semiannual registration fee
16 for such vehicle is deposited in the Cycle Rider Safety
17 Training Fund.
18 (e) Of the monies received by the Secretary of State as
19 registration fees or taxes or as payment of any other fee, as
20 provided in this Act, except fees received by the Secretary
21 under paragraph (7) of subsection (b) of Section 5-101 and
22 Section 5-109 of this Code, 37% shall be deposited into the
23 State Construction Fund.
24 (f) Of the total money collected for a CDL instruction
25 permit or original or renewal issuance of a commercial
26 driver's license (CDL) pursuant to the Uniform Commercial
27 Driver's License Act (UCDLA): (i) $6 of the total fee for an
28 original or renewal CDL, and $6 of the total CDL instruction
29 permit fee when such permit is issued to any person holding a
30 valid Illinois driver's license, shall be paid into the
31 CDLIS/AAMVAnet Trust Fund (Commercial Driver's License
32 Information System/American Association of Motor Vehicle
33 Administrators network Trust Fund) and shall be used for the
34 purposes provided in Section 6z-23 of the State Finance Act

1 and (ii) $20 of the total fee for an original or renewal CDL
2 or commercial driver instruction permit shall be paid into
3 the Motor Carrier Safety Inspection Fund, which is hereby
4 created as a special fund in the State Treasury, to be used
5 by the Department of State Police, subject to appropriation,
6 to hire additional officers to conduct motor carrier safety
7 inspections pursuant to Chapter 18b of this Code.
8 (g) All remaining moneys received by the Secretary of
9 State as registration fees or taxes or as payment of any
10 other fee, as provided in this Act, except fees received by
11 the Secretary under paragraph (7) of subsection (b) of
12 Section 5-101 and Section 5-109 of this Code, shall be
13 deposited in the Road Fund in the State Treasury. Moneys in
14 the Road Fund shall be used for the purposes provided in
15 Section 8.3 of the State Finance Act.

19 (k) There is created in the State Treasury a special
20 fund to be known as the Secretary of State Special License
21 Plate Fund. Money deposited into the Fund shall, subject to
22 appropriation, be used by the Office of the Secretary of
23 State (i) to help defray plate manufacturing and plate
24 processing costs for the issuance and, when applicable,
25 renewal of any new or existing special registration plates
26 authorized under this Code and (ii) for grants made by the
27 Secretary of State to benefit Illinois Veterans Home
28 libraries.
29 On or before October 1, 1995, the Secretary of State
30 shall direct the State Comptroller and State Treasurer to
31 transfer any unexpended balance in the Special Environmental
32 License Plate Fund, the Special Korean War Veteran License
33 Plate Fund, and the Retired Congressional License Plate Fund
34 to the Secretary of State Special License Plate Fund.

1 (l) The Motor Vehicle Review Board Fund is created as a
2 special fund in the State Treasury. Moneys deposited into
3 the Fund under paragraph (7) of subsection (b) of Section
4 5-101 and Section 5-109 shall, subject to appropriation, be
5 used by the Office of the Secretary of State to administer
6 the Motor Vehicle Review Board, including without limitation
7 payment of compensation and all necessary expenses incurred
8 in administering the Motor Vehicle Review Board under the
9 Motor Vehicle Franchise Act.
10 (m) Effective July 1, 1996, there is created in the
11 State Treasury a special fund to be known as the Family
12 Responsibility Fund. Moneys deposited into the Fund shall,
13 subject to appropriation, be used by the Office of the
14 Secretary of State for the purpose of enforcing the Family
15 Financial Responsibility Law.
16 (n) The Illinois Fire Fighters' Memorial Fund is created
17 as a special fund in the State Treasury. Moneys deposited
18 into the Fund shall, subject to appropriation, be used by the
19 Office of the State Fire Marshal for construction of the
20 Illinois Fire Fighters' Memorial to be located at the State
21 Capitol grounds in Springfield, Illinois. Upon the
22 completion of the Memorial, moneys in the Fund shall be used
23 in accordance with Section 3-634.
24 (o) Of the money collected for each certificate of title
25 for all-terrain vehicles and off-highway motorcycles, $17
26 shall be deposited into the Off-Highway Vehicle Trails Fund.
