SYNOPSIS AS INTRODUCED:
 
225 ILCS 605/3.3

    Amends the Animal Welfare Act. Provides that an animal shelter or animal control facility may waive the fee for sterilizing and microchipping a dog or cat (in addition to waiving the adoption fee) and if the person adopting the dog or cat is a veteran and meets specified criteria. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Animal Welfare Act is amended by changing
5Section 3.3 as follows:
 
6    (225 ILCS 605/3.3)
7    Sec. 3.3. Adoption of dogs and cats.
8    (a) An animal shelter or animal control facility shall not
9adopt out any dog or adopt out or return to field any cat
10unless it has been sterilized and microchipped. However, an
11animal shelter or animal control facility may adopt out a dog
12or cat that has not been sterilized and microchipped if the
13adopting owner has executed a written agreement to have
14sterilizing and microchipping procedures performed within 14
15days after a licensed veterinarian certifies the dog or cat is
16healthy enough for sterilizing and microchipping procedures
17and a licensed veterinarian has certified that the dog or cat
18is too sick or injured to be sterilized or it would be
19detrimental to the health of the dog or cat to be sterilized or
20microchipped at the time of the adoption.
21    (b) An animal shelter or animal control facility may adopt
22out any dog or cat that is not free of disease, injury, or
23abnormality if the disease, injury, or abnormality is

1disclosed in writing to the adopter, and the animal shelter or
2animal control facility allows the adopter to return the
3animal to the animal shelter or animal control facility.
4    (c) The requirements of subsections (a) and (b) of this
5Section do not apply to adoptions subject to Section 11 of the
6Animal Control Act.
7    (d) An animal shelter or animal control facility shall
8waive the adoption fee for a dog or cat and may waive the fee
9for microchipping and sterilizing the dog or cat if the person
10adopting the dog or cat:
11        (1) presents to the animal shelter or animal control
12    facility a current and valid Illinois driver's license
13    with the word "veteran" printed on its face, a current and
14    valid Illinois Identification Card with the word "veteran"
15    printed on its face, or an identification card issued
16    under the federal Veterans Identification Card Act of 2015
17    and a valid Illinois driver's license or valid Illinois
18    Identification Card; and
19        (2) complies with the adoption policies of the animal
20    shelter or animal control facility.
21    (e) An animal shelter or animal control facility may limit
22the number of dogs or cats adopted from that animal shelter or
23animal control facility pursuant to this Section to one dog or
24cat each in a 2-year period.
