SYNOPSIS AS INTRODUCED:
 
605 ILCS 5/6-115  from Ch. 121, par. 6-115

    Amends the Illinois Highway Code. Provides that a board of trustees in a county under township organization or a county organized as a commission form of government with a road district may elect or appoint a highway commissioner or clerk (rather than may appoint a highway commissioner) or contract with a neighboring township or road district (rather than contract with a neighboring township) to provide highway commissioner or clerk services. In provisions concerning a county organized as a commission form of government, removes residency requirements for a candidate to provide highway commissioner or clerk services.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Highway Code is amended by
5changing Section 6-115 as follows:
 
6    (605 ILCS 5/6-115)  (from Ch. 121, par. 6-115)
7    Sec. 6-115. (a) Except as provided in Section 10-20 of the
8Township Code or subsections (b) and (c), no person shall be
9eligible to the office of highway commissioner or clerk unless
10he shall be a legal voter and has been one year a resident of
11the district. In road districts that elect a clerk, the same
12limitation shall apply to the district clerk.
13    (b) A board of trustees in a county organized under
14Division 2-1 of the Counties Code may (i) elect or appoint a
15non-resident or a resident that has not resided in the
16district for one year to be a highway commissioner or clerk, or
17(ii) contract with a neighboring township or road district to
18provide highway commissioner or clerk services if:
19        (1) the district is within a township with no
20    incorporated town;
21        (2) the township has a population of less than 1,000;
22    and
23        (3) no qualified candidate who has resided in the

1    township for at least one year is willing to serve as
2    highway commissioner or clerk.
3    (c) A county A board of trustees in a county organized
4under Division 2-4 of the Counties Code with a road district
5may (i) elect or appoint a non-resident or a resident who has
6not resided in the district for one year to be a highway
7commissioner or clerk, or (ii) contract with a neighboring
8township or road district to provide highway commissioner or
9clerk services if no qualified candidate who has resided in
10the road district for at least one year is willing to serve as
11highway commissioner or clerk.
