| | | Amends the Criminal Code of 2012. Provides that any person legally authorized to treat, transport, or store human remains, except as authorized by law, shall not: (1) knowingly and intentionally provide inaccurate documentation of the identity of human remains to an individual or organization; (2) knowingly and intentionally store human remains in violation of Illinois law; or (3) knowingly and intentionally provide an individual or organization with human remains that are intentionally misidentified. Provides that a violation is a Class 4 felony. |

| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Criminal Code of 2012 is amended by adding |
| 5 | | Section 17-5.8 as follows:
|
| 6 | | (720 ILCS 5/17-5.8 new) |
| 7 | | Sec. 17-5.8. Mishandling of human remains. |
| 8 | | (a) Any person legally authorized to treat, transport, or |
| 9 | | store human remains, except as authorized by law, shall not: |
| 10 | | (1) knowingly and intentionally provide inaccurate |
| 11 | | documentation of the identity of human remains to an |
| 12 | | individual or organization; |
| 13 | | (2) knowingly and intentionally store human remains in |
| 14 | | violation of Illinois law; or |
| 15 | | (3) knowingly and intentionally provide an individual |
| 16 | | or organization with human remains that are intentionally |
| 17 | | misidentified. |
| 18 | | (b) Sentence. A person who violates this Section is guilty |
| 19 | | of a Class 4 felony. |
