AMENDMENT TO SENATE BILL 3097

2    AMENDMENT NO. ______. Amend Senate Bill 3097 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Fire Protection District Act is amended by
5adding Section 15e as follows:
 
6    (70 ILCS 705/15e new)
7    Sec. 15e. Dissolution of Elk Grove Rural Fire Protection
8District.
9    (a) The Elk Grove Rural Fire Protection District shall be
10dissolved by operation of law effective immediately upon the
11occurrence of all the conditions set forth in subsection (c).
12    (b) The president of the board of trustees of the Elk Grove
13Rural Fire Protection District serving on October 1, 2023 and
14the mayor of the Village of Mount Prospect are hereby
15appointed and authorized to close up the business affairs of
16the Elk Grove Rural Fire Protection District, including by

1performing, or causing to be performed, all activities
2necessary to cause the conditions set forth in subsection (c)
3to be satisfied. The president of the board of trustees of the
4Elk Grove Rural Fire Protection District serving on October 1,
52023 and the mayor of the Village of Mount Prospect shall
6unanimously approve all actions taken by them in connection
7with the closing up of the business affairs of the Elk Grove
8Rural Fire Protection District.
9    (c) After all the following conditions have been
10satisfied, the dissolution of the Elk Grove Rural Fire
11Protection District shall become effective immediately:
12        (1) the payment of all outstanding liabilities of the
13    Elk Grove Rural Fire Protection District;
14        (2) the conveyance of title of all of the Elk Grove
15    Rural Fire Protection District's remaining real and
16    personal property to the Village of Mount Prospect in
17    accordance with the agreement entered into between the Elk
18    Grove Rural Fire Protection District, the Village of Mount
19    Prospect, and Elk Grove Township; and
20        (3) the submittal to, and approval by resolution
21    adopted by, the Cook County Board of Commissioners of an
22    accounting showing that all known outstanding liabilities
23    of the Elk Grove Fire Protection District have been paid
24    and title of all of the Elk Grove Rural Fire Protection
25    District's known real and personal property has been
26    conveyed to the Village of Mount Prospect.

1        After the Cook County Board of Commissioners passes a
2    resolution approving the accounting described in this
3    paragraph (3), title of any remaining money of the Elk
4    Grove Rural Fire Protection District shall, by operation
5    of law, be transferred to the Village of Mount Prospect in
6    accordance with the agreement entered into between the Elk
7    Grove Rural Fire Protection District, the Village of Mount
8    Prospect, and Elk Grove Township.
9    Any bank or other financial institution at which the Elk
10Grove Rural Fire Protection District has accounts is
11authorized, upon presentment of a certified copy of the
12resolution passed by the Cook County Board of Commissioners
13approving the accounting described in paragraph (3), to
14transfer the funds in the Elk Grove Rural Fire Protection
15District's accounts to the Village of Mount Prospect.
16    (d) Notwithstanding the requirements of Section 27-5 of
17the Property Tax Code, the Special Service Area created by the
18Village of Mount Prospect and approved by Cook County in order
19to take the place of the Elk Grove Rural Fire Protection
20District's tax levy after dissolution shall not require
21geographical contiguity.
 
22    Section 99. Effective date. This Act takes effect upon
23becoming law.".
