AMENDMENT TO SENATE BILL 2803

2    AMENDMENT NO. ______. Amend Senate Bill 2803 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Identification Card Act is
5amended by changing Sections 4 and 12 as follows:

8    Sec. 4. Identification card.
9    (a) The Secretary of State shall issue a standard Illinois
10Identification Card to any natural person who is a resident of
11the State of Illinois who applies for such card, or renewal
12thereof. No identification card shall be issued to any person
13who holds a valid foreign state identification card, license,
14or permit unless the person first surrenders to the Secretary
15of State the valid foreign state identification card, license,
16or permit. The card shall be prepared and supplied by the

1Secretary of State and shall include a photograph and
2signature or mark of the applicant. However, the Secretary of
3State may provide by rule for the issuance of Illinois
4Identification Cards without photographs if the applicant has
5a bona fide religious objection to being photographed or to
6the display of his or her photograph. The Illinois
7Identification Card may be used for identification purposes in
8any lawful situation only by the person to whom it was issued.
9As used in this Act, "photograph" means any color photograph
10or digitally produced and captured image of an applicant for
11an identification card. As used in this Act, "signature" means
12the name of a person as written by that person and captured in
13a manner acceptable to the Secretary of State.
14    (a-5) If an applicant for an identification card has a
15current driver's license or instruction permit issued by the
16Secretary of State, the Secretary may require the applicant to
17utilize the same residence address and name on the
18identification card, driver's license, and instruction permit
19records maintained by the Secretary. The Secretary may
20promulgate rules to implement this provision.
21    (a-10) If the applicant is a judicial officer as defined
22in Section 1-10 of the Judicial Privacy Act or a peace officer,
23the applicant may elect to have his or her office or work
24address listed on the card instead of the applicant's
25residence or mailing address. The Secretary may promulgate
26rules to implement this provision. For the purposes of this

1subsection (a-10), "peace officer" means any person who by
2virtue of his or her office or public employment is vested by
3law with a duty to maintain public order or to make arrests for
4a violation of any penal statute of this State, whether that
5duty extends to all violations or is limited to specific
6violations.
7    (a-15) The Secretary of State may provide for an expedited
8process for the issuance of an Illinois Identification Card.
9The Secretary shall charge an additional fee for the expedited
10issuance of an Illinois Identification Card, to be set by
11rule, not to exceed $75. All fees collected by the Secretary
12for expedited Illinois Identification Card service shall be
13deposited into the Secretary of State Special Services Fund.
14The Secretary may adopt rules regarding the eligibility,
15process, and fee for an expedited Illinois Identification
16Card. If the Secretary of State determines that the volume of
17expedited identification card requests received on a given day
18exceeds the ability of the Secretary to process those requests
19in an expedited manner, the Secretary may decline to provide
20expedited services, and the additional fee for the expedited
21service shall be refunded to the applicant.
22    (a-20) The Secretary of State shall issue a standard
23Illinois Identification Card to a person committed to the
24Department of Corrections, the or Department of Juvenile
25Justice, a Federal Bureau of Prisons facility located in
26Illinois, or a county jail or county department of corrections

1as follows: upon receipt of the person's birth certificate,
2social security card, photograph, proof of residency upon
3discharge, and an identification card application transferred
4via a secure method as agreed upon by the Secretary and the
5Department of Corrections or Department of Juvenile Justice.
6Illinois residency shall be established by submission of a
7Secretary of State prescribed Identification Card verification
8form completed by the respective Department.
9        (1) A committed person who has previously held an
10    Illinois Identification Card or an Illinois driver's
11    license shall submit an Identification Card verification
12    form to the Secretary of State, including a photograph
13    taken by the correctional facility, proof of residency
14    upon discharge, and a social security number, if the
15    committed person has a social security number. If the
16    committed person does not have a social security number
17    and is eligible for a social security number, the
18    Secretary of State shall not issue a standard Illinois
19    Identification Card until the committed person obtains a
20    social security number. If the committed person's
21    photograph and demographic information matches an existing
22    Illinois Identification Card or Illinois driver's license
23    and the Secretary of State verifies the applicant's social
24    security number with the Social Security Administration,
25    the Secretary of State shall issue the committed person a
26    standard Illinois Identification Card. If the photograph

1    or demographic information matches an existing Illinois
2    Identification Card or Illinois driver's license in
3    another person's name or identity, a standard Illinois
4    Identification Card shall not be issued until the
5    committed person submits a certified birth certificate and
6    social security card to the Secretary of State and the
7    Secretary of State verifies the identity of the committed
8    person. If the Secretary of State cannot find a match to an
9    existing Illinois Identification Card or Illinois driver's
10    license, the committed person may apply for a standard
11    Illinois Identification card as described in paragraph
12    (2).
13        (2) A committed person who has not previously held an
14    Illinois Identification Card or Illinois driver's license
15    or for whom a match cannot be found as described in
16    paragraph (1) shall submit an Identification Card
17    verification form, including a photograph taken by the
18    correctional facility, a certified birth certificate,
19    proof of residency upon discharge, and a social security
20    number, if the committed has a social security number. If
21    the committed person does not have a social security
22    number and is eligible for a social security number, the
23    Secretary of State shall not issue a standard Illinois
24    Identification Card until the committed person obtains a
25    social security number. If the Secretary of State verifies
26    the applicant's social security number with the Social

1    Security Administration, the Secretary of State shall
2    issue the committed person a standard Illinois
3    Identification Card.
4    The Illinois Identification Card verification form
5described in this subsection shall be prescribed by the
6Secretary State. The Secretary of State and correctional
7facilities in this State shall establish a secure method to
8transfer the form.
9    (a-25) The Secretary of State shall issue a limited-term
10Illinois Identification Card valid for 90 days to a committed
11person upon release on parole, mandatory supervised release,
12aftercare release, final discharge, or pardon from the
13Department of Corrections, the or Department of Juvenile
14Justice, a Federal Bureau of Prisons facility located in
15Illinois, or a county jail or county department of
16corrections, if the released person does not obtain a standard
17Illinois Identification Card as described in subsection (a-20)
18prior to release is unable to present a certified copy of his
19or her birth certificate and social security card or other
20documents authorized by the Secretary, but does present a
21Secretary of State prescribed Identification Card verification
22form completed by the correctional facility Department of
23Corrections or Department of Juvenile Justice, verifying the
24released person's date of birth, social security number, if
25the person has a social security number, and his or her
26Illinois residence address. The verification form must have

1been completed no more than 30 days prior to the date of
2application for the Illinois Identification Card.
3    Prior to the expiration of the 90-day period of the
4limited-term Illinois Identification Card, if the released
5person submits to the Secretary of State a certified copy of
6his or her birth certificate and his or her social security
7card or other documents authorized by the Secretary, a
8standard Illinois Identification Card shall be issued. A
9limited-term Illinois Identification Card may not be renewed.
10    This subsection shall not apply to a released person who
11was unable to obtain a standard Illinois Identification Card
12because his or her photograph or demographic information
13matched an existing Illinois Identification Card or Illinois
14driver's license in another person's name or identity or to a
15released person who does not have a social security number and
16is eligible for a social security number.
17    (a-30) The Secretary of State shall issue a standard
18Illinois Identification Card to a person upon conditional
19release or absolute discharge from the custody of the
20Department of Human Services, if the person presents a
21certified copy of his or her birth certificate, social
22security card, or other documents authorized by the Secretary,
23and a document proving his or her Illinois residence address.
24The Secretary of State shall issue a standard Illinois
25Identification Card to a person prior to his or her
26conditional release or absolute discharge if personnel from

1the Department of Human Services bring the person to a
2Secretary of State location with the required documents.
3Documents proving residence address may include any official
4document of the Department of Human Services showing the
5person's address after release and a Secretary of State
6prescribed verification form, which may be executed by
7personnel of the Department of Human Services.
8    (a-35) The Secretary of State shall issue a limited-term
9Illinois Identification Card valid for 90 days to a person
10upon conditional release or absolute discharge from the
11custody of the Department of Human Services, if the person is
12unable to present a certified copy of his or her birth
13certificate and social security card or other documents
14authorized by the Secretary, but does present a Secretary of
15State prescribed verification form completed by the Department
16of Human Services, verifying the person's date of birth and
17social security number, and a document proving his or her
18Illinois residence address. The verification form must have
19been completed no more than 30 days prior to the date of
20application for the Illinois Identification Card. The
21Secretary of State shall issue a limited-term Illinois
22Identification Card to a person no sooner than 14 days prior to
23his or her conditional release or absolute discharge if
24personnel from the Department of Human Services bring the
25person to a Secretary of State location with the required
26documents. Documents proving residence address shall include

1any official document of the Department of Human Services
2showing the person's address after release and a Secretary of
3State prescribed verification form, which may be executed by
4personnel of the Department of Human Services.
5    (b) The Secretary of State shall issue a special Illinois
6Identification Card, which shall be known as an Illinois
7Person with a Disability Identification Card, to any natural
8person who is a resident of the State of Illinois, who is a
9person with a disability as defined in Section 4A of this Act,
10who applies for such card, or renewal thereof. No Illinois
11Person with a Disability Identification Card shall be issued
12to any person who holds a valid foreign state identification
13card, license, or permit unless the person first surrenders to
14the Secretary of State the valid foreign state identification
15card, license, or permit. The Secretary of State shall charge
16no fee to issue such card. The card shall be prepared and
17supplied by the Secretary of State, and shall include a
18photograph and signature or mark of the applicant, a
19designation indicating that the card is an Illinois Person
20with a Disability Identification Card, and shall include a
21comprehensible designation of the type and classification of
22the applicant's disability as set out in Section 4A of this
23Act. However, the Secretary of State may provide by rule for
24the issuance of Illinois Person with a Disability
25Identification Cards without photographs if the applicant has
26a bona fide religious objection to being photographed or to

1the display of his or her photograph. If the applicant so
2requests, the card shall include a description of the
3applicant's disability and any information about the
4applicant's disability or medical history which the Secretary
5determines would be helpful to the applicant in securing
6emergency medical care. If a mark is used in lieu of a
7signature, such mark shall be affixed to the card in the
8presence of two witnesses who attest to the authenticity of
9the mark. The Illinois Person with a Disability Identification
10Card may be used for identification purposes in any lawful
11situation by the person to whom it was issued.
12    The Illinois Person with a Disability Identification Card
13may be used as adequate documentation of disability in lieu of
14a physician's determination of disability, a determination of
15disability from a physician assistant, a determination of
16disability from an advanced practice registered nurse, or any
17other documentation of disability whenever any State law
18requires that a person with a disability provide such
19documentation of disability, however an Illinois Person with a
20Disability Identification Card shall not qualify the
21cardholder to participate in any program or to receive any
22benefit which is not available to all persons with like
23disabilities. Notwithstanding any other provisions of law, an
24Illinois Person with a Disability Identification Card, or
25evidence that the Secretary of State has issued an Illinois
26Person with a Disability Identification Card, shall not be

1used by any person other than the person named on such card to
2prove that the person named on such card is a person with a
3disability or for any other purpose unless the card is used for
4the benefit of the person named on such card, and the person
5named on such card consents to such use at the time the card is
6so used.
7    An optometrist's determination of a visual disability
8under Section 4A of this Act is acceptable as documentation
9for the purpose of issuing an Illinois Person with a
10Disability Identification Card.
11    When medical information is contained on an Illinois
12Person with a Disability Identification Card, the Office of
13the Secretary of State shall not be liable for any actions
14taken based upon that medical information.
15    (c) The Secretary of State shall provide that each
16original or renewal Illinois Identification Card or Illinois
17Person with a Disability Identification Card issued to a
18person under the age of 21 shall be of a distinct nature from
19those Illinois Identification Cards or Illinois Person with a
20Disability Identification Cards issued to individuals 21 years
21of age or older. The color designated for Illinois
22Identification Cards or Illinois Person with a Disability
23Identification Cards for persons under the age of 21 shall be
24at the discretion of the Secretary of State.
25    (c-1) Each original or renewal Illinois Identification
26Card or Illinois Person with a Disability Identification Card

1issued to a person under the age of 21 shall display the date
2upon which the person becomes 18 years of age and the date upon
3which the person becomes 21 years of age.
4    (c-3) The General Assembly recognizes the need to identify
5military veterans living in this State for the purpose of
6ensuring that they receive all of the services and benefits to
7which they are legally entitled, including healthcare,
8education assistance, and job placement. To assist the State
9in identifying these veterans and delivering these vital
10services and benefits, the Secretary of State is authorized to
11issue Illinois Identification Cards and Illinois Person with a
12Disability Identification Cards with the word "veteran"
13appearing on the face of the cards. This authorization is
14predicated on the unique status of veterans. The Secretary may
15not issue any other identification card which identifies an
16occupation, status, affiliation, hobby, or other unique
17characteristics of the identification card holder which is
18unrelated to the purpose of the identification card.
19    (c-5) Beginning on or before July 1, 2015, the Secretary
20of State shall designate a space on each original or renewal
21identification card where, at the request of the applicant,
22the word "veteran" shall be placed. The veteran designation
23shall be available to a person identified as a veteran under
24subsection (b) of Section 5 of this Act who was discharged or
25separated under honorable conditions.
26    (d) The Secretary of State may issue a Senior Citizen

1discount card, to any natural person who is a resident of the
2State of Illinois who is 60 years of age or older and who
3applies for such a card or renewal thereof. The Secretary of
4State shall charge no fee to issue such card. The card shall be
5issued in every county and applications shall be made
6available at, but not limited to, nutrition sites, senior
7citizen centers and Area Agencies on Aging. The applicant,
8upon receipt of such card and prior to its use for any purpose,
9shall have affixed thereon in the space provided therefor his
10signature or mark.
11    (e) The Secretary of State, in his or her discretion, may
12designate on each Illinois Identification Card or Illinois
13Person with a Disability Identification Card a space where the
14card holder may place a sticker or decal, issued by the
15Secretary of State, of uniform size as the Secretary may
16specify, that shall indicate in appropriate language that the
17card holder has renewed his or her Illinois Identification
18Card or Illinois Person with a Disability Identification Card.

15Identification Card, which shall be known as an Illinois
16Person with a Disability Identification Card, to any natural
17person who is a resident of the State of Illinois, who is a
18person with a disability as defined in Section 4A of this Act,
19who applies for such card, or renewal thereof. No Illinois
20Person with a Disability Identification Card shall be issued
21to any person who holds a valid foreign state identification
22card, license, or permit unless the person first surrenders to
23the Secretary of State the valid foreign state identification
24card, license, or permit. The Secretary of State shall charge
25no fee to issue such card. The card shall be prepared and
26supplied by the Secretary of State, and shall include a

1photograph and signature or mark of the applicant, a
2designation indicating that the card is an Illinois Person
3with a Disability Identification Card, and shall include a
4comprehensible designation of the type and classification of
5the applicant's disability as set out in Section 4A of this
6Act. However, the Secretary of State may provide by rule for
7the issuance of Illinois Person with a Disability
8Identification Cards without photographs if the applicant has
9a bona fide religious objection to being photographed or to
10the display of his or her photograph. If the applicant so
11requests, the card shall include a description of the
12applicant's disability and any information about the
13applicant's disability or medical history which the Secretary
14determines would be helpful to the applicant in securing
15emergency medical care. If a mark is used in lieu of a
16signature, such mark shall be affixed to the card in the
17presence of two witnesses who attest to the authenticity of
18the mark. The Illinois Person with a Disability Identification
19Card may be used for identification purposes in any lawful
20situation by the person to whom it was issued.
21    The Illinois Person with a Disability Identification Card
22may be used as adequate documentation of disability in lieu of
23a physician's determination of disability, a determination of
24disability from a physician assistant, a determination of
25disability from an advanced practice registered nurse, or any
26other documentation of disability whenever any State law

1requires that a person with a disability provide such
2documentation of disability, however an Illinois Person with a
3Disability Identification Card shall not qualify the
4cardholder to participate in any program or to receive any
5benefit which is not available to all persons with like
6disabilities. Notwithstanding any other provisions of law, an
7Illinois Person with a Disability Identification Card, or
8evidence that the Secretary of State has issued an Illinois
9Person with a Disability Identification Card, shall not be
10used by any person other than the person named on such card to
11prove that the person named on such card is a person with a
12disability or for any other purpose unless the card is used for
13the benefit of the person named on such card, and the person
14named on such card consents to such use at the time the card is
15so used.
16    An optometrist's determination of a visual disability
17under Section 4A of this Act is acceptable as documentation
18for the purpose of issuing an Illinois Person with a
19Disability Identification Card.
20    When medical information is contained on an Illinois
21Person with a Disability Identification Card, the Office of
22the Secretary of State shall not be liable for any actions
23taken based upon that medical information.
24    (c) The Secretary of State shall provide that each
25original or renewal Illinois Identification Card or Illinois
26Person with a Disability Identification Card issued to a

1person under the age of 21 shall be of a distinct nature from
2those Illinois Identification Cards or Illinois Person with a
3Disability Identification Cards issued to individuals 21 years
4of age or older. The color designated for Illinois
5Identification Cards or Illinois Person with a Disability
6Identification Cards for persons under the age of 21 shall be
7at the discretion of the Secretary of State.
8    (c-1) Each original or renewal Illinois Identification
9Card or Illinois Person with a Disability Identification Card
10issued to a person under the age of 21 shall display the date
11upon which the person becomes 18 years of age and the date upon
12which the person becomes 21 years of age.
13    (c-3) The General Assembly recognizes the need to identify
14military veterans living in this State for the purpose of
15ensuring that they receive all of the services and benefits to
16which they are legally entitled, including healthcare,
17education assistance, and job placement. To assist the State
18in identifying these veterans and delivering these vital
19services and benefits, the Secretary of State is authorized to
20issue Illinois Identification Cards and Illinois Person with a
21Disability Identification Cards with the word "veteran"
22appearing on the face of the cards. This authorization is
23predicated on the unique status of veterans. The Secretary may
24not issue any other identification card which identifies an
25occupation, status, affiliation, hobby, or other unique
26characteristics of the identification card holder which is

1unrelated to the purpose of the identification card.
2    (c-5) Beginning on or before July 1, 2015, the Secretary
3of State shall designate a space on each original or renewal
4identification card where, at the request of the applicant,
5the word "veteran" shall be placed. The veteran designation
6shall be available to a person identified as a veteran under
7subsection (b) of Section 5 of this Act who was discharged or
8separated under honorable conditions.
9    (d) The Secretary of State may issue a Senior Citizen
10discount card, to any natural person who is a resident of the
11State of Illinois who is 60 years of age or older and who
12applies for such a card or renewal thereof. The Secretary of
13State shall charge no fee to issue such card. The card shall be
14issued in every county and applications shall be made
15available at, but not limited to, nutrition sites, senior
16citizen centers and Area Agencies on Aging. The applicant,
17upon receipt of such card and prior to its use for any purpose,
18shall have affixed thereon in the space provided therefor his
19signature or mark.
20    (e) The Secretary of State, in his or her discretion, may
21designate on each Illinois Identification Card or Illinois
22Person with a Disability Identification Card a space where the
23card holder may place a sticker or decal, issued by the
24Secretary of State, of uniform size as the Secretary may
25specify, that shall indicate in appropriate language that the
26card holder has renewed his or her Illinois Identification

2affirmation by the applicant on a form provided by the
3Secretary of State, that such person resides in a veterans
4home or veterans hospital operated by the State or federal
5government.
6    The application of a homeless individual for an Illinois
7Identification Card to be issued at no fee must be accompanied
8by an affirmation by a qualified person, as defined in Section
94C of this Act, on a form provided by the Secretary of State,
10that the applicant is currently homeless as defined in Section
111A of this Act.
12    For the application for the first Illinois Identification
13Card of a youth for whom the Department of Children and Family
14Services is legally responsible or a foster child to be issued
15at no fee, the youth must submit, along with the application,
16an affirmation by his or her court appointed attorney or an
17employee of the Department of Children and Family Services on
18a form provided by the Secretary of State, that the person is a
19youth for whom the Department of Children and Family Services
20is legally responsible or a foster child.
21    The fee for any duplicate identification card shall be
22waived for any person who presents the Secretary of State's
23Office with a police report showing that his or her
24identification card was stolen.
25    The fee for any duplicate identification card shall be
26waived for any person age 60 or older whose identification

1card has been lost or stolen.
2    As used in this Section, "active-duty member of the United
3States Armed Forces" means a member of the Armed Services or
4Reserve Forces of the United States or a member of the Illinois
5National Guard who is called to active duty pursuant to an
6executive order of the President of the United States, an act
7of the Congress of the United States, or an order of the
8Governor.

12    Section 95. No acceleration or delay. Where this Act makes
13changes in a statute that is represented in this Act by text
14that is not yet or no longer in effect (for example, a Section
15represented by multiple versions), the use of that text does
16not accelerate or delay the taking effect of (i) the changes
17made by this Act or (ii) provisions derived from any other
18Public Act.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
