SYNOPSIS AS INTRODUCED:
 
210 ILCS 9/113

    Amends the Assisted Living and Shared Housing Act. Provides that one representative of the Office of the State Long Term Care Ombudsman (instead of one representative of the Department on Aging) is a nonvoting member of the Assisted Living and Shared Housing Advisory Board. Adds a certified long term care ombudsman and 3 current or former residents of an assisted living establishment or shared housing establishment as voting members of the Board.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Assisted Living and Shared Housing Act is
5amended by changing Section 113 as follows:

9    Sec. 113. Assisted Living and Shared Housing Advisory
10Board.
11    (a) The Governor shall establish an Assisted Living and
12Shared Housing Advisory Board. The Advisory Board shall
13consist of the following members:
14        (1) the Director, who shall serve as chair and as an ex
15    officio, nonvoting member;
16        (2) the Director of Aging, who shall serve as
17    vice-chair and as an ex officio, nonvoting member;
18        (3) the following nonvoting members, appointed by the
19    Director:
20            (A) one representative of the Department; and
21            (B) one representative of the Office of the State
22        Long Term Care Ombudsman Department on Aging;
23        (4) the following voting members, appointed by the

1    Director:
2            (A) 6 members selected from candidates recommended
3        by an organization of providers whose membership
4        consists of assisted living establishments;
5            (B) 3 members appointed by the Director from
6        candidates recommended by a consumer organization that
7        engages solely in advocacy or legal representation on
8        behalf of senior citizens;
9            (C) a physician;
10            (D) a registered professional nurse; and
11            (E) 2 members with expertise in the area of
12        gerontology research or legal research regarding
13        implementation of laws applying to assisted living
14        establishments; .
15            (F) a certified long term care ombudsman; and
16            (G) 3 current or former residents of an assisted
17        living establishment or shared housing establishment.
18    (b) Members of the Advisory Board shall serve for terms of
193 years or until the member's successor is appointed by the
20Director, but the Director shall stagger the terms of initial
21appointees to the Advisory Board as follows: the terms of
22one-third shall expire after one year; the terms of one-third
23shall expire after 2 years; and the terms of one-third shall
24expire after 3 years. All initial members shall be appointed
25by January 1, 2025. Any member appointed to fill a vacancy
26occurring before the expiration of the term for which his or

1her predecessor was appointed shall be appointed for the
2remainder of that term. The Advisory Board shall meet
3quarterly and at the call of the Director. The affirmative
4vote of 9 voting members of the Advisory Board shall be
5necessary for any action of the Advisory Board. Members of the
6Advisory Board shall receive no compensation for their
7services but shall be reimbursed for their actual expenses.
8    (c) The Advisory Board shall be provided copies of any
9additions or changes to the Assisted Living and Shared Housing
10Establishment Code for review and comment prior to notice
11being given to the public. If the Advisory Board, having been
12asked for its review, fails to advise the Department within 90
13days, the additions or changes shall be considered acted upon
14in accordance with this Section.
