AMENDMENT TO SENATE BILL 2278

2    AMENDMENT NO. ______. Amend Senate Bill 2278 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Highway Code is amended by
5changing Section 6-201.22 as follows:
 
6    (605 ILCS 5/6-201.22)
7    Sec. 6-201.22. Truck length Road weight restriction;
8notice and hearing. If not already required by the local
9ordinance or resolution process, jurisdictions at a minimum
10must follow the public notification process set forth in this
11Section. Whenever the local authorities with respect to
12highways under their jurisdiction wish highway commissioner
13wishes to permanently post a road to prohibit trucks over 55
14feet in length, they at a reduced weight limit, he or she shall
15fix a time and place to examine the section of roadway route of
16the township or district road, and hear reasons for or against

1permanently posting a road at a reduced truck length weight
2limit.
3    The local authority highway commissioner shall give
4written notice at least 10 days prior to the time of
5examination or and hearing to the public county superintendent
6of highways. The local authority He or she shall also provide
7notice by publication in at least one newspaper published in
8the jurisdiction township or district. In the absence of a
9newspaper published in the jurisdiction township or district,
10notice by publication shall be provided in at least one
11newspaper of general circulation in the jurisdiction township
12or district. In the absence of a generally circulated
13newspaper in the jurisdiction township or district, notice by
14publication shall be made by posting notices in 5 of the most
15public places in the jurisdiction district in the vicinity of
16the road to be permanently posted at a reduced truck length
17weight limit.
18    The highway commissioner may, by written notice to the
19county superintendent of highways, by public announcement, and
20by posting notice at the time and place named for the first
21hearing, adjourn a hearing from time to time, but not for a
22longer period than 10 days. At the hearing, or the adjourned
23hearing, the commissioner shall decide and publicly announce
24whether he or she will permanently post a road at a reduced
25weight limit. The highway commissioner shall issue a signed
26memorandum explaining the decision to permanently post a road

1at a reduced weight limit, and address any concerns raised at
2the public hearing. The signed memorandum shall be filed
3within 5 days after the hearing in the office of the district
4clerk. The highway commissioner shall also send a copy of the
5signed memorandum to the county superintendent of highways.
6The county superintendent of highways may approve the decision
7of the highway commissioner by signing the memorandum and
8filing it in the office of the district clerk. Upon the
9approval of the decision by the county superintendent of
10highways and filing of the memorandum with the office of the
11district clerk, the road may be posted at a reduced weight
12limit by the highway commissioner.

14    Section 10. The Illinois Vehicle Code is amended by
15changing Sections 15-103, 15-107, 15-116, and 15-316 as
16follows:
 
17    (625 ILCS 5/15-103)  (from Ch. 95 1/2, par. 15-103)
18    Sec. 15-103. Height of vehicles. Except as provided in
19Section 15-316, the The height of a vehicle from the under side
20of the tire to the top of the vehicle, inclusive of load, shall
21not exceed 13 feet, 6 inches on any highway in the State.
22    A person convicted of violating this Section is subject to
23the penalty provided in paragraph (b) of Section 15-113.

1    (625 ILCS 5/15-107)   (from Ch. 95 1/2, par. 15-107)
2    Sec. 15-107. Length of vehicles.
3    (a) The maximum length of a single vehicle on any highway
4of this State may not exceed 42 feet except the following:
5        (1) Semitrailers.
6        (2) Charter or regulated route buses may be up to 45
7    feet in length, not including energy absorbing bumpers.
8    (a-1) A motor home as defined in Section 1-145.01 may be up
9to 45 feet in length, not including energy absorbing bumpers.
10The length limitations described in this subsection (a-1)
11shall be exclusive of energy-absorbing bumpers and rear view
12mirrors.
13    (b) (Blank).
14    (c) Except as provided in subsections (c-1) and (c-2),
15combinations of vehicles may not exceed a total of 2 vehicles
16except the following:
17        (1) A truck tractor semitrailer may draw one trailer.
18        (2) A truck tractor semitrailer may draw one converter
19    dolly or one semitrailer.
20        (3) A truck tractor semitrailer may draw one vehicle
21    that is defined in Chapter 1 as special mobile equipment,
22    provided the overall dimension does not exceed 60 feet.
23        (4) A truck in transit may draw 3 trucks in transit
24    coupled together by the triple saddlemount method.
25        (5) Recreational vehicles consisting of 3 vehicles,

1    provided the following:
2            (A) The total overall dimension does not exceed 60
3        feet.
4            (B) The towing vehicle is a properly registered
5        vehicle capable of towing another vehicle using a
6        fifth-wheel type assembly.
7            (C) The second vehicle in the combination of
8        vehicles is a recreational vehicle that is towed by a
9        fifth-wheel assembly. This vehicle must be properly
10        registered and must be equipped with brakes,
11        regardless of weight.
12            (D) The third vehicle must be the lightest of the 3
13        vehicles and be a trailer or semitrailer designed or
14        used for transporting a boat, all-terrain vehicle,
15        personal watercraft, or motorcycle.
16            (E) The towed vehicles may be only for the use of
17        the operator of the towing vehicle.
18            (F) All vehicles must be properly equipped with
19        operating brakes and safety equipment required by this
20        Code, except the additional brake requirement in
21        subdivision (C) of this subparagraph (5).
22        (6) A tow truck in combination with a disabled vehicle
23    or combination of disabled vehicles, provided the towing
24    vehicle:
25            (A) Is specifically designed as a tow truck having
26        a gross vehicle weight rating of at least 18,000

1        pounds and equipped with air brakes, provided that air
2        brakes are required only if the towing vehicle is
3        towing a vehicle, semitrailer, or tractor-trailer
4        combination that is equipped with air brakes. For the
5        purpose of this subsection, gross vehicle weight
6        rating, or GVWR, means the value specified by the
7        manufacturer as the loaded weight of the tow truck.
8            (B) Is equipped with flashing, rotating, or
9        oscillating amber lights, visible for at least 500
10        feet in all directions.
11            (C) Is capable of utilizing the lighting and
12        braking systems of the disabled vehicle or combination
13        of vehicles.
14            (D) Does not engage a tow exceeding 50 highway
15        miles from the initial point of wreck or disablement
16        to a place of repair. Any additional movement of the
17        vehicles may occur only upon issuance of authorization
18        for that movement under the provisions of Sections
19        15-301 through 15-318 of this Code.
20        The Department may by rule or regulation prescribe
21    additional requirements regarding length limitations for a
22    tow truck towing another vehicle.
23        For purposes of this Section, a tow-dolly that merely
24    serves as substitute wheels for another legally licensed
25    vehicle is considered part of the licensed vehicle and not
26    a separate vehicle.

1        (7) Commercial vehicles consisting of 3 vehicles,
2    provided the following:
3            (A) The total overall dimension does not exceed 65
4        feet.
5            (B) The towing vehicle is a properly registered
6        vehicle capable of towing another vehicle using a
7        fifth-wheel type assembly or a goose-neck hitch ball.
8            (C) The third vehicle must be the lightest of the 3
9        vehicles and be a trailer or semitrailer.
10            (D) All vehicles must be properly equipped with
11        operating brakes and safety equipment required by this
12        Code.
13            (E) The combination of vehicles must be operated
14        by a person who holds a commercial driver's license
15        (CDL).
16            (F) The combination of vehicles must be en route
17        to a location where new or used trailers are sold by an
18        Illinois or out-of-state licensed new or used trailer
19        dealer.
20    (c-1) A combination of 3 vehicles is allowed access to any
21State designated highway if:
22        (1) the length of neither towed vehicle exceeds 28.5
23    feet;
24        (2) the overall wheel base of the combination of
25    vehicles does not exceed 62 feet; and
26        (3) the combination of vehicles is en route to a

1    location where new or used trailers are sold by an
2    Illinois or out-of-state licensed new or used trailer
3    dealer.
4    (c-2) A combination of 3 vehicles is allowed access from
5any State designated highway onto any county, township, or
6municipal highway for a distance of 5 highway miles for the
7purpose of delivery or collection of one or both of the towed
8vehicles if:
9        (1) the length of neither towed vehicle exceeds 28.5
10    feet;
11        (2) the combination of vehicles does not exceed 40,000
12    pounds in gross weight and 8 feet 6 inches in width;
13        (3) there is no sign prohibiting that access;
14        (4) the route is not being used as a thoroughfare
15    between State designated highways; and
16        (5) the combination of vehicles is en route to a
17    location where new or used trailers are sold by an
18    Illinois or out-of-state licensed new or used trailer
19    dealer.
20    (d) On Class I highways there are no overall length
21limitations on motor vehicles operating in combinations
22provided:
23        (1) The length of a semitrailer, unladen or with load,
24    in combination with a truck tractor may not exceed 53
25    feet.
26        (2) The distance between the kingpin and the center of

1    the rear axle of a semitrailer longer than 48 feet, in
2    combination with a truck tractor, may not exceed 45 feet 6
3    inches. The limit contained in this paragraph (2) shall
4    not apply to trailers or semi-trailers used for the
5    transport of livestock as defined by Section 18b-101.
6        (3) The length of a semitrailer or trailer, unladen or
7    with load, operated in a truck tractor-semitrailer-trailer
8    or truck tractor semitrailer-semitrailer combination, may
9    not exceed 28 feet 6 inches.
10        (4) Maxi-cube combinations, as defined in Chapter 1,
11    may not exceed 65 feet overall dimension.
12        (5) Combinations of vehicles specifically designed to
13    transport motor vehicles or boats may not exceed 65 feet
14    overall dimension. The length limitation is inclusive of
15    front and rear bumpers but exclusive of the overhang of
16    the transported vehicles, as provided in paragraph (i) of
17    this Section.
18        (6) Stinger-steered semitrailer vehicles specifically
19    designed to transport motor vehicles or boats and
20    automobile transporters, as defined in Chapter 1, may not
21    exceed 80 feet overall dimension. The length limitation is
22    inclusive of front and rear bumpers but exclusive of the
23    overhang of the transported vehicles, as provided in
24    paragraph (i) of this Section.
25        (7) A truck in transit transporting 3 trucks coupled
26    together by the triple saddlemount method may not exceed

1    97 feet overall dimension.
2        (8) A towaway trailer transporter combination may not
3    exceed 82 feet overall dimension.
4    Vehicles operating during daylight hours when transporting
5poles, pipes, machinery, or other objects of a structural
6nature that cannot readily be dismantled or disassembled are
7exempt from length limitations, provided that no object may
8exceed 80 feet in length and the overall dimension of the
9vehicle including the load may not exceed 100 feet. This
10exemption does not apply to operation on a Saturday, Sunday,
11or legal holiday. Legal holidays referred to in this Section
12are the days on which the following traditional holidays are
13celebrated: New Year's Day; Memorial Day; Independence Day;
14Labor Day; Thanksgiving Day; and Christmas Day.
15    Vehicles and loads operated by a public utility while en
16route to make emergency repairs to public service facilities
17or properties are exempt from length limitations, provided
18that during night operations every vehicle and its load must
19be equipped with a sufficient number of clearance lamps on
20both sides and marker lamps on the extreme ends of any
21projecting load to clearly mark the dimensions of the load.
22    A tow truck in combination with a disabled vehicle or
23combination of disabled vehicles, as provided in paragraph (6)
24of subsection (c) of this Section, is exempt from length
25limitations.
26    The length limitations described in this paragraph (d)

1shall be exclusive of safety and energy conservation devices,
2such as bumpers, refrigeration units or air compressors and
3other devices, that the Department may interpret as necessary
4for safe and efficient operation; except that no device
5excluded under this paragraph shall have by its design or use
6the capability to carry cargo.
7    Section 5-35 of the Illinois Administrative Procedure Act
8relating to procedures for rulemaking shall not apply to the
9designation of highways under this paragraph (d).
10    (e) On Class II highways there are no overall length
11limitations on motor vehicles operating in combinations,
12provided:
13        (1) The length of a semitrailer, unladen or with load,
14    in combination with a truck tractor, may not exceed 53
15    feet overall dimension.
16        (2) The distance between the kingpin and the center of
17    the rear axle of a semitrailer longer than 48 feet, in
18    combination with a truck tractor, may not exceed 45 feet 6
19    inches. The limit contained in this paragraph (2) shall
20    not apply to trailers or semi-trailers used for the
21    transport of livestock as defined by Section 18b-101.
22        (3) A truck tractor-semitrailer-trailer or truck
23    tractor semitrailer-semitrailer combination may not exceed
24    65 feet in dimension from front axle to rear axle.
25        (4) The length of a semitrailer or trailer, unladen or
26    with load, operated in a truck tractor-semitrailer-trailer

1    or truck tractor semitrailer-semitrailer combination, may
2    not exceed 28 feet 6 inches.
3        (5) Maxi-cube combinations, as defined in Chapter 1,
4    may not exceed 65 feet overall dimension.
5        (6) A combination of vehicles, specifically designed
6    to transport motor vehicles or boats, may not exceed 65
7    feet overall dimension. The length limitation is inclusive
8    of front and rear bumpers but exclusive of the overhang of
9    the transported vehicles, as provided in paragraph (i) of
10    this Section.
11        (7) Stinger-steered semitrailer vehicles specifically
12    designed to transport motor vehicles or boats may not
13    exceed 80 feet overall dimension. The length limitation is
14    inclusive of front and rear bumpers but exclusive of the
15    overhang of the transported vehicles, as provided in
16    paragraph (i) of this Section.
17        (8) A truck in transit transporting 3 trucks coupled
18    together by the triple saddlemount method may not exceed
19    97 feet overall dimension.
20        (9) A towaway trailer transporter combination may not
21    exceed 82 feet overall dimension.
22    Vehicles operating during daylight hours when transporting
23poles, pipes, machinery, or other objects of a structural
24nature that cannot readily be dismantled or disassembled are
25exempt from length limitations, provided that no object may
26exceed 80 feet in length and the overall dimension of the

25other devices, that the Department may interpret as necessary

1excluded under this paragraph shall have by its design or use
2the capability to carry cargo.
3    Section 5-35 of the Illinois Administrative Procedure Act

6    (e-1) (Blank).
7    (e-2) Except as provided in subsection (e-3), combinations
8of vehicles over 65 feet in length, with no overall length
9limitation except as provided in subsections (d) and (e) of
10this Section, are allowed access as follows:
11        (1) From a Class I highway onto any street or highway
12    for a distance of one highway mile for the purpose of
13    loading, unloading, food, fuel, repairs, and rest,
14    provided there is no sign prohibiting that access.
15        (2) From a Class I or Class II highway onto any
16    non-designated highway for a distance of 5 highway miles
17    for the purpose of loading, unloading, food, fuel,
18    repairs, and rest if:
19            (A) there is no sign prohibiting that access; and
20            (B) the route is not being used as a thoroughfare
21        between Class I or Class II highways.
22    (e-3) Combinations of vehicles over 65 feet in length
23operated by household goods carriers or towaway trailer
24transporter combinations, with no overall length limitations
25except as provided in subsections (d) and (e) of this Section,
26have unlimited access to points of loading, unloading, or

1delivery to or from a manufacturer, distributor, or dealer.
2    (f) On non-designated highways, except as provided in
3Section 15-316, the maximum length limitations for vehicles in
4combination are as follows:
5        (1) A truck tractor in combination with a semitrailer
6    may not exceed 65 feet overall dimension. An agency or
7    instrumentality of the State of Illinois or any unit of
8    local government shall not be required to widen or
9    otherwise alter a non-designated highway constructed
10    before January 1, 2018 to accommodate truck
11    tractor-semitrailer combinations under this paragraph (1).
12        (2) Semitrailers, unladen or with load, may not exceed
13    53 feet overall dimension.
14        (3) A truck tractor-semitrailer-trailer or truck
15    tractor semitrailer-semitrailer may not exceed 60 feet
16    overall dimension.
17        (4) The distance between the kingpin and the center
18    axle of a semitrailer longer than 48 feet, in combination
19    with a truck tractor, may not exceed 42 feet 6 inches. The
20    limit contained in this paragraph (4) shall not apply to
21    trailers or semi-trailers used for the transport of
22    livestock as defined by Section 18b-101.
23    (g) Length limitations in the preceding subsections of
24this Section 15-107 do not apply to the following:
25        (1) Vehicles operated in the daytime, except on
26    Saturdays, Sundays, or legal holidays, when transporting

1    poles, pipe, machinery, or other objects of a structural
2    nature that cannot readily be dismantled or disassembled,
3    provided the overall length of vehicle and load may not
4    exceed 100 feet and no object exceeding 80 feet in length
5    may be transported unless a permit has been obtained as
6    authorized in Section 15-301. As used in this Section,
7    "legal holiday" means any of the following days: New
8    Year's Day; Memorial Day; Independence Day; Labor Day;
9    Thanksgiving Day; and Christmas Day.
10        (2) Vehicles and loads operated by a public utility
11    while en route to make emergency repairs to public service
12    facilities or properties, but during night operation every
13    vehicle and its load must be equipped with a sufficient
14    number of clearance lamps on both sides and marker lamps
15    upon the extreme ends of any projecting load to clearly
16    mark the dimensions of the load.
17        (3) A tow truck in combination with a disabled vehicle
18    or combination of disabled vehicles, as provided in
19    paragraph (6) of subsection (c) of this Section, is exempt
20    from length limitations.
21     The towing vehicle, however, may tow any disabled vehicle
22from the initial point of wreck or disablement to a point where
23repairs are actually to occur. This movement shall be valid
24only on State routes. The tower must abide by posted bridge
25weight limits.
26    All other combinations not listed in this subsection (f)

1may not exceed 60 feet overall dimension.
2    (h) The load upon any vehicle operated alone, or the load
3upon the front vehicle of a combination of vehicles, shall not
4extend more than 3 feet beyond the front wheels of the vehicle
5or the front bumper of the vehicle if it is equipped with a
6front bumper. The provisions of this subsection (h) shall not
7apply to any vehicle or combination of vehicles specifically
8designed for the collection and transportation of waste,
9garbage, or recyclable materials during the vehicle's
10operation in the course of collecting garbage, waste, or
11recyclable materials if the vehicle is traveling at a speed
12not in excess of 15 miles per hour during the vehicle's
13operation and in the course of collecting garbage, waste, or
14recyclable materials. However, in no instance shall the load
15extend more than 7 feet beyond the front wheels of the vehicle
16or the front bumper of the vehicle if it is equipped with a
17front bumper.
18    (i) The load upon the front vehicle of an automobile
19transporter or a stinger-steered vehicle specifically designed
20to transport motor vehicles shall not extend more than 4 feet
21beyond the foremost part of the transporting vehicle and the
22load upon the rear transporting vehicle shall not extend more
23than 6 feet beyond the rear of the bed or body of the vehicle.
24This paragraph shall only be applicable upon highways
25designated in paragraphs (d) and (e) of this Section.
26    (j) Articulated vehicles comprised of 2 sections, neither

1of which exceeds a length of 42 feet, designed for the carrying
2of more than 10 persons, may be up to 60 feet in length, not
3including energy absorbing bumpers, provided that the vehicles
4are:
5        1. operated by or for any public body or motor carrier
6    authorized by law to provide public transportation
7    services; or
8        2. operated in local public transportation service by
9    any other person and the municipality in which the service
10    is to be provided approved the operation of the vehicle.
11    (j-1) (Blank).
12    (k) Any person who is convicted of violating this Section
13is subject to the penalty as provided in paragraph (b) of
14Section 15-113.

18    Sec. 15-116. Highway designations.
19    (a) The Department of Transportation shall maintain and
20provide a listing of all Class I and Class II designated
21streets and highways as defined in Chapter 1 of this Code.
22    (b) The Department shall also maintain and provide a
23listing of all local streets or highways that have been
24designated Class II by local agencies.
25    (c) Local agencies shall be responsible for reporting to

1the Department all streets and highways under their
2jurisdiction designated Class II. Local agencies shall also
3provide to the Department reference contact names and
4telephone numbers.
5    (d) The Department shall also maintain and provide an
6official map of the Designated State Truck Route System that
7includes State and local streets and highways that have been
8designated Class I or Class II.
9    (e) If a unit of local government has no Class II
10designated truck routes, the unit of local government shall
11affirm to the Department that it has no such truck routes.
12    (f) Each unit of local government shall may report to the
13Department, and the Department shall post on its official
14website, any limitations prohibiting the operation of vehicles
15imposed by ordinance or resolution in the unit of local
16government's non-designated highway system.

19    Sec. 15-316. When the Department or local authority may
20restrict right to use highways.
21    (a) Except as provided in subsection (g), local
22authorities with respect to highways under their jurisdiction
23may by ordinance or resolution prohibit the operation of
24vehicles upon any such highway or impose restrictions as to
25the weight of vehicles to be operated upon any such highway,

1for a total period of not to exceed 90 days, measured in either
2consecutive or nonconsecutive days at the discretion of local
3authorities, in any one calendar year, whenever any said
4highway by reason of deterioration, rain, snow, or other
5climate conditions will be seriously damaged or destroyed
6unless the use of vehicles thereon is prohibited or the
7permissible weights thereof reduced.
8    (b) The local authority enacting any such ordinance or
9resolution shall erect or cause to be erected and maintained
10signs designating the provision of the ordinance or resolution
11at each end of that portion of any highway affected thereby,
12and the ordinance or resolution shall not be effective unless
13and until such signs are erected and maintained. To be
14effective, an ordinance or resolution passed to designate a
15Class II roadway need not require that signs be erected, but
16the designation shall be reported to the Department.
17    (c) Local authorities with respect to highways under their
18jurisdiction may also, by ordinance or resolution, prohibit
19the operation of trucks or other commercial vehicles, or may
20impose limitations as the weight or length thereof, on
21designated highways, which prohibitions and limitations shall
22be marked designated by appropriate signs placed on such
23highways.

1thereof at a reduced weight limit unless the decision to do so
2is made in accordance with Section 6-201.22 of the Illinois
3Highway Code.
4    (d) The Department shall likewise have authority as
5hereinbefore granted to local authorities to determine by
6resolution and to impose restrictions as to the weight or
7length of vehicles operated upon any highway under the
8jurisdiction of said department, and such restrictions shall
9be effective when signs giving notice thereof are erected upon
10the highway or portion of any highway affected by such
11resolution.

14    (e) When any vehicle is operated in violation of this
15Section, the owner or driver of the vehicle shall be deemed
16guilty of a violation and either the owner or the driver of the
17vehicle may be prosecuted for the violation. Any person, firm,
18or corporation convicted of violating this Section shall be
19fined $50 for any weight exceeding the posted limit up to the
20axle or gross weight limit allowed a vehicle as provided for in
21subsections (a) or (b) of Section 15-111 and $75 per every 500
22pounds or fraction thereof for any weight exceeding that which
23is provided for in subsections (a) or (b) of Section 15-111.
24    (f) A municipality is authorized to enforce a county
25weight limit ordinance applying to county highways within its
26corporate limits and is entitled to the proceeds of any fines

1collected from the enforcement.
2    (g) An ordinance or resolution enacted by a county or
3township pursuant to subsection (a) of this Section shall not
4apply to cargo tank vehicles with two or three permanent axles
5when delivering propane for emergency heating purposes if the
6cargo tank is loaded at no more than 50 percent capacity, the
7gross vehicle weight of the vehicle does not exceed 32,000
8pounds, and the driver of the cargo tank vehicle notifies the
9appropriate agency or agencies with jurisdiction over the
10highway before driving the vehicle on the highway pursuant to
11this subsection. The cargo tank vehicle must have an operating
12gauge on the cargo tank which indicates the amount of propane
13as a percent of capacity of the cargo tank. The cargo tank must
14have the capacity displayed on the cargo tank, or
15documentation of the capacity of the cargo tank must be
16available in the vehicle. For the purposes of this subsection,
17propane weighs 4.2 pounds per gallon. This subsection does not
18apply to municipalities. Nothing in this subsection shall
19allow cargo tank vehicles to cross bridges with posted weight
20restrictions if the vehicle exceeds the posted weight limit.
