SYNOPSIS AS INTRODUCED:
 
215 ILCS 5/356z.61 new

    Amends the Accident and Health Article of the Illinois Insurance Code. Provides that every policy issued, amended, delivered, or renewed in this State on or after January 1, 2025 shall provide coverage for the domestic partner, child of the domestic partner, sibling, parent, or live-in family member of an insured or policyholder that is equal to and subject to the same terms and conditions as the coverage provided to a spouse or an insured policyholder.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Insurance Code is amended by
5adding Section 356z.61 as follows:
 
6    (215 ILCS 5/356z.61 new)
7    Sec. 356z.61. Equal coverage for family members.
8    (a) As used in this Section, "terms", "conditions", and
9"coverage" do not include instances of differential treatment
10of a domestic partner, child of a domestic partner, sibling,
11parent, live-in family member, or spouse under federal law.
12    (b) Every policy of accident and health insurance issued,
13amended, delivered, or renewed in this State on or after
14January 1, 2025 shall provide coverage for a domestic partner,
15child of a domestic partner, sibling, parent, or live-in
16family member of an insured or policyholder that is equal to
17and subject to the same terms and conditions as the coverage
18provided to a spouse of an insured or policyholder. A policy of
19accident and health insurance may not offer or provide
20coverage for a domestic partner, child of a domestic partner,
21sibling, parent, or live-in family member if it is not equal to
22the coverage provided for the spouse of an insured or
23policyholder.
