SYNOPSIS AS INTRODUCED:
 
20 ILCS 1305/10-75 new

    Amends the Department of Human Services Act. Provides that a person is eligible for a diaper allowance in the amount of $70 per month per eligible child if all of the following conditions are met: (1) the person's household income is at or below 100% of the federal poverty guidelines updated periodically in the Federal Register by the U.S. Department of Health and Human Services; and (2) the person is responsible for the welfare of an eligible child. Defines "eligible child" to mean any child who is 3 years of age or younger and whose primary residence is the State of Illinois. Provides that the diaper allowance may be used only to purchase diapers. Provides that the diaper allowance shall be distributed in a form and manner prescribed by the Department of Human Services. Provides that the diaper allowance shall not be considered income for purposes of determining eligibility or the amount of assistance for any public aid benefit provided under State law. Requires applicants for the diaper allowance to apply to the Department in a form and manner prescribed by the Department. Effective July 1, 2023.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Human Services Act is amended
5by adding Section 10-75 as follows:
 
6    (20 ILCS 1305/10-75 new)
7    Sec. 10-75. Diaper allowance.
8    (a) As used in this Section, "eligible child" means any
9child who is 3 years of age or younger and whose primary
10residence is the State of Illinois.
11    (b) A person is eligible for a diaper allowance in the
12amount of $70 per month per eligible child if all of the
13following conditions are met:
14        (1) the person's household income is at or below 100%
15    of the federal poverty guidelines updated periodically in
16    the Federal Register by the U.S. Department of Health and
17    Human Services under the authority of 42 U.S.C. 9902(2);
18    and
19        (2) the person is responsible for the welfare of an
20    eligible child, as defined by this Section.
21    The diaper allowance may be used only to purchase diapers.
22    (c) The diaper allowance shall be distributed in a form
23and manner prescribed by the Department.

1    (d) The diaper allowance shall not be considered income
2for purposes of determining eligibility or the amount of
3assistance for any public aid benefit provided under State
4law.
5    (e) Applicants for the diaper allowance shall apply to the
6Department in a form and manner prescribed by the Department.
 
7    Section 99. Effective date. This Act takes effect July 1,
