AMENDMENT TO SENATE BILL 426

2    AMENDMENT NO. ______. Amend Senate Bill 426 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Unified Code of Corrections is amended by
5adding Section 3-9-2.1 as follows:
 
6    (730 ILCS 5/3-9-2.1 new)
7    Sec. 3-9-2.1. Emerging adult programs.
8    (a) The Department of Juvenile Justice may establish and
9offer emerging adult programs for persons at least 18 years of
10age and under 22 years of age who are committed to the
11Department of Corrections.
12    (b) Persons at least 18 years of age and under 22 years of
13age who are in the custody of the Department of Corrections may
14be transferred to Department of Juvenile Justice facilities
15for the purposes of participating in emerging adult programs
16provided that all such transfers comply with the federal

1Juvenile Justice and Delinquency Prevention Act of 1974 and
2the federal Prison Rape Elimination Act of 2003.
3    (c) No transfer of any person in the custody of the
4Department of Corrections shall occur without written approval
5of the Director of Juvenile Justice and the Director of
6Corrections.
7    (d) The Department of Juvenile Justice and Department of
8Corrections shall establish an intergovernmental agreement to
9govern eligibility criteria and transfer policies and
10procedures for persons at least 18 years of age and under 22
11years of age who are in the custody of the Department of
12Corrections and are seeking transfer to Department of Juvenile
13Justice facilities for the purposes of participating in
14emerging adult programs.".
