1    AN ACT concerning revenue.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Housing Development Act is amended
5by adding Section 35 as follows:
 
6    (20 ILCS 3805/35 new)
7    Sec. 35. Property Tax Payment Plan Task Force.
8    (a) In counties with 3,000,000 or more inhabitants, the
9annual tax sale has a disproportionately negative impact on
10minority communities. The loss of owner-occupied homes
11following the annual tax sale results in a loss of home equity
12for impacted households and negatively impacts the ability of
13those households to build generational wealth. The creation of
14a well-designed payment plan program that allows
15owner-occupants to repay delinquent property taxes has the
16potential to help homeowners who are unable to afford their
17property taxes avoid the tax sale and the potential loss of
18their home while also ensuring that property taxes are
19collected for the benefit of local taxing districts. Such a
20payment plan program will result in a more equitable and
21effective property tax system.
22    (b) The Property Tax Payment Plan Task Force is hereby
23created. The Task Force shall consist of the following

1members:
2        (1) one member, who shall serve as co-chairperson of
3    the Task Force, appointed by the President of the Senate;
4        (2) one member, who shall serve as co-chairperson of
5    the Task Force, appointed by the Speaker of the House of
6    Representatives;
7        (3) one member appointed by the Minority Leader of the
8    Senate;
9        (4) one member appointed by the Minority Leader of the
10    House of Representatives;
11        (5) the Executive Director of the Illinois Housing
12    Development Authority or his or her designee;
13        (6) the Cook County Treasurer or his or her designee;
14        (7) the Cook County Clerk or his or her designee;
15        (8) the President of the Cook County Board of
16    Commissioners or his or her designee;
17        (9) up to 2 members, appointed by the co-chairpersons
18    of the Task Force, representing nonprofit affordable
19    housing organizations in counties with 3,000,000 or more
20    inhabitants, housing counseling organizations in counties
21    with 3,000,000 or more inhabitants, or homeownership
22    organizations in counties with 3,000,000 or more
23    inhabitants;
24        (10) up to 2 members, appointed by the co-chairpersons
25    of the Task Force, representing community, neighborhood,
26    or resident associations in counties with 3,000,000 or

1    more inhabitants;
2        (11) up to 2 members, appointed by the co-chairpersons
3    of the Task Force, representing public interest
4    organizations from counties with 3,000,000 or more
5    inhabitants or civic organizations from counties with
6    3,000,000 or more inhabitants;
7        (12) the Village President of the Village of Hazel
8    Crest or his or her designee;
9        (13) the Mayor of the City of Harvey or his or her
10    designee;
11        (14) the Village President of the Village of Richton
12    Park or his or her designee; and
13        (15) up to 3 members, appointed by the co-chairpersons
14    of the Task Force, representing taxing districts, other
15    than municipalities, with properties that are the most
16    highly represented in the annual tax sale in counties with
17    3,000,000 or more inhabitants.
18    At the discretion of both of the Co-Chairpersons of the
19Task Force, additional individuals may participate as
20nonvoting members of the Task Force.
21    Members of the Task Force shall be appointed no later than
2230 days after the effective date of this amendatory Act of the
23103rd General Assembly. If any members are not appointed
24within that 30-day period, the appointing authority shall be
25deemed to have waived the right to make that appointment.
26Vacancies in the Task Force, other than a vacancy occurring

1because of a waiver by the appointing authority under this
2subsection, shall be filled by the original appointing
3authority.
4    (c) Members of the Task Force shall serve without
5compensation. The Illinois Housing Development Authority shall
6provide administrative support to the Task Force as needed.
7    (d) The members of the Task Force are exempt from any
8training, disclosure, or filing requirements under the State
9Officials and Employees Ethics Act, the Illinois Governmental
10Ethics Act, or any other applicable State law or rule imposing
11such requirements.
12    (e) Once all of the members have been appointed, the Task
13Force shall meet not less than 4 times to carry out the duties
14prescribed in this Section. Members of the Task Force may
15attend those meetings virtually.
16    (f) The Task Force shall study and make recommendations
17for the implementation of one or more payment plan options in
18counties with 3,000,000 or more inhabitants to prevent
19eligible tax-delinquent owner-occupied properties in those
20counties from being sold at the annual tax sale. The Task Force
21shall take into consideration the impact of the payment plan
22option on homeowners, taxpayers, local agencies responsible
23for the collection of property taxes, and local taxing
24districts. These recommendations may be used to recommend
25legislation in the 103rd General Assembly or a subsequent
26General Assembly.

1    (g) A report detailing the Task Force's findings,
2conclusions, and recommendations shall be submitted to the
3General Assembly no later than November 15, 2023. The Task
4Force is dissolved upon submission of the report.
5    (h) This Section is repealed on January 1, 2025.
 
6    Section 99. Effective date. This Act takes effect upon
7becoming law.
