105 ILCS 5/34-18.85 new

    Amends the School Code. Provides that notwithstanding any other State law to the contrary, from July 1, 2024 until July 1, 2028, any State mandate under the State Mandates Act enacted after July 1, 2024 does not apply to a school district if the State mandate is non-academic. Provides that the State Board of Education shall determine if a State mandate is non-academic. Effective July 1, 2024.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Sections
510-20.87 and 34-18.85 as follows:
 
6    (105 ILCS 5/10-20.87 new)
7    Sec. 10-20.87. State mandate applicability.
8    (a) In this Section: "non-academic" means anything that
9does not have to do with the core academic curricula within
10mathematics, reading, and writing.
11    (b) Notwithstanding any other State law to the contrary,
12from July 1, 2024 until July 1, 2028, any State mandate under
13the State Mandates Act enacted after July 1, 2024 does not
14apply to a school district if the State mandate is
15non-academic.
16    (c) The State Board of Education shall determine if a
17State mandate is non-academic.
